BATAVIA Simmons sentenced to jail time in harassment case

Jacquetta Simmons appeared in City Court Wednesday afternoon for sentencing in a harassment case that occurred over two years ago.

Simmons, who appeared with Public Defender Jerry Ader after her Attorney Ann Nichols relieved herself as Simmons counsel last week, was sentenced to 15 days in the Genesee County Jail and will have to pay a $250 fine.

An order of protection for the victim was issued for 2 more years.

On August 31, 2016, Simmons pleaded guilty to harassment 2nd after having physical contact with Katherine Shannon, 55, at a church event at the YWCA in October of 2014.

Simmons pulled the victims hair out during a dispute where there was physical contact.

In April of 2016, Simmons was picked up on warrant stemming from the incident.

Rochester Police located Simmons and turned her over to Batavia Police.

At the advice of the Monroe and Genesee County Probation Departments in their pre-sentence reports, Judge Durin Rogers sentenced Simmons to local jail time as opposed to anger management counseling which was recommended by Ader.

“You seem to lack the ability to understand or recognize your responsibility in these actions,” says Judge Roger’s.

“Add this to your previous felony assault conviction.”

Judge Rogers went on to say that in the pre-sentence
report, Simmons still blames the victim and says that she started it.

Ader said his client has enrolled in classes to help with her issues and has been attending 4 days a week since October 31.

“These charges were filed over 2 years ago, there have been no further incidents since then,” Ader told the court.

Judge Rogers told Ader the harassment occurred 10 months after the assault conviction.

” I don’t think counseling will help in this case”

Simmons had nothing to say to the court before sentencing.
