WYOMING COUNTY SHERIFF’S REPORT/Plow truck driver issued ticket after accident

The Wyoming County Sheriff’s Office is investigating a two car motor vehicle accident on Oatka Road, just west of Smallwood Road, in the Town of Warsaw that occurred on December 17, 2016.

Heinrich J. Buck, 29, of Warsaw, was plowing a residential driveway when he was unable to exit the driveway. Buck then drove through the lawn of the residence and entered the roadway with the plow truck without looking for oncoming vehicles and struck a vehicle which was westbound on Oatka Road.

The vehicle that was struck was operated by David L. Phillips, 66, of Castile.

Phillips’ vehicle was struck on the passenger side by Buck’s vehicle which pushed it across the eastbound lane into a utility pole, breaking the pole.

Phillips and his 72 year old female passenger were transported by Warsaw Ambulances to the Wyoming County Community Hospital for minor injuries and were later released.

Warsaw Fire Department personnel and Deputy Majtyka assisted at the scene.

Buck was issued a uniform traffic ticket for failing to yield the right of way when entering the roadway. He will answer the ticket in January of 2017 in Warsaw Town Court.

 

Bradley P. Fairchok, 22, of Perry, was arrested following a traffic stop on  Route 39 in the Town of Castile on December 17, 2016. Fairchok was stopped for failure to dim high beams, and during the stop he was found to have an expired and suspended driver’s license.

Fairchok is charged with aggravated unlicensed operation 3rd, unlicensed operation, and failure to dim high beams.

Fairchok was released and is scheduled to appear in the Town of Castile Court on January 9, 2017 to answer the charges.
