BATAVIA/Pair claiming to be police officers enter home on Swan street attempting to steal items, residents injured in incident

On Thursday March 23rd at 2:22 am, the Batavia Police Department investigated the report of unlawful entry into a house at 49 Swan Street.

While inside the residence the two perpetrators identified themselves as police officers and then caused physical injury to the occupants of the home. 

Officers arrived and detained one person still in the house and observed another person fleeing on foot.

That person was pursued on foot by police and was taken into custody after following the use of a taser by Batavia Police Officers.

The perpetrators were identified as Kolton Cotter and Andrew Morris, further investigation by the Batavia Police Department determined that the two planned to enter the home unlawfully by claiming to be undercover police officers and steal property. 

 Kolton Cotter, 22, of Eagle Harbor Rd., Albion NY, is charged with, robbery, burglary, coercion, conspiracy, criminal possession of a weapon, criminal impersonation, petit larceny, criminal mischief, assault, possession of burglar tools, unlawful imprisonment, criminal obstruction of breathing, obstruction of governmental administration, resisting arrest and unlawful possession of marijuana.

 Andrew Morris, 19, of  Main St., Attica, is charged with robbery, burglary, coercion, conspiracy, criminal possession of a weapon, criminal impersonation, petit larceny, assault, possession of burglar tools, unlawful imprisonment.

 Both Cotter and Morris were arraigned in Batavia City Court and remanded to jail with no bail until a future court date.
