BATAVIA/Washington avenue man turns himself in, appears in City Court today after warrant issued yesterday

Eddie L. Miles Jr., 45, turned himself in to Batavia City Court Thursday morning after a bench warrant was issued by Judge Rogers Wednesday afternoon for failing to appear on the charges of criminal obstruction of breathing and the torturing and injuring of an animal charges in an incident on Lewis Place on July 31, 2017.

Miles Jr. appeared before Judge Balbick with Assistant Public Defender Jamie Welch and was released with a new court appearance date of August 30, 2017 at 12:30 p.m. in front of Judge Rogers. He is currently out of jail on bail.

According to the statements made by the victim in the case, she took her dog Zeus, a Pit bull, out to go to the bathroom at about 1130a.m. on July 31, 2017 and was walking him to the backyard on Lewis Place when she saw Eddie Miles Jr., walking on Hutchins place. The victim says in her supporting deposition that she ignored  him and kept walking to the backyard because there was a cat nearby and Zeus does not like cats.

“When I got to the corner by the fence I heard something and turned around and that’s when Eddie took his right arm and put it around my neck and dug his thumb into my neck.”

The victim went on to say, “He grabbed Zeus’ leash and pulled him up with the choke collar and pulled out something from his left side. Zeus is afraid of him because he used to belong to Eddie and he abused him, the victim stated, so we adopted him and Eddie has tried several times to get Zeus.”

“Eddie came around with his left hand and took a long needle, about 4 inches long, and stuck it into Zeus’ neck. The needle had some light purple liquid in it and he injected all of it into him.”

“I got out of Eddie’s hold and Eddie let go of Zeus’ leash and Zeus ran to the house. Eddie said “Ill be back” and he took off running down Lewis Place to State street.”

The victim says she then went inside and Zeus was laying on the floor. She then went to the neighbors house to call her family.

Miles Jr. is also to appear on August 23, 2017 after being picked up on a warrant on July 5, 2017 for an incident that occurred on Washington avenue on May 18, 2017 where Miles Jr., allegedly took a car belonging to his girlfriend without her permission.

Miles Jr. is facing a grand larceny 4th charge and unauthorized use of a vehicle charge in that case which are felonies. He is also charged with criminal contempt 2nd after disobeying a court order of protection that was issued in City Court on March 9, 2017 and expires in March of 2019.

Miles Jr’s girlfriend says Miles was having a verbal argument with her and he took her car without permission.
