BATAVIA POLICE REPORT/Chase Park man charged with attempted assault in incident

Dalton C. Kelley, 20, of Chase Park, Batavia, is charged with attempted assault 3rd and harassment 2nd after an incident on Chase Park on January 3, 2018.

Kelley allegedly struck a person in the forehead and also a police officer.

Kelley was arraigned in City Court and jailed in lieu of $2,500 bail/bond. He is due back in court on January 11, 2018.

Kelley was also charged with two counts of criminal mischief 4th following the incident on January 3, 2018, where he allegedly keyed two vehicles not belonging to him.

On these charges, Kelley was released on appearance tickets and he will appear in City Court on January 16, 2018.

 

 

Austin L. Wester, 23, of Pratt Rd., Batavia, is charged with possession of a forged instrument 2nd after he was allegedly found to be in possession and cashing four separate checks belonging to another person. The owner of the checks did not issue them to Wester nor anyone else.

Wester was arraigned in City Court and released on recognizance pending his next court date on February 22, 2018.

 

 

Winston A Lockhart, 22, of Holland Ave., Batavia, was arrested on several active warrants from October 2017 after police were dispatched to a Holland avenue residence for a disturbance on January 2, 2018.  After the disturbance was resolved, police discovered that Lockhart had active warrants out of the City of Batavia on harassment 2nd charges. He also had an active warrant out of the Genesee County Sheriff’s Office.

Lockhart was arrested and issued an appearance ticket, he was then turned over to the Sheriff’s Office.

 

Joseph  M. Smith, 41, of State St., Batavia, is charged with petit larceny after allegedly stealing money from his employer at 629 East Main street on November 23, 2017.

Smith was issued an appearance ticket and will appear in City Court on January 9, 2018.

 

Justin T. Gladney, 28, no address provided, of Batavia, is charged with criminal trespass 3rd and unlawful possession of marijuana after he allegedly entered and remained in the building at 1 City Centre, while City Hall was closed on December 29, 2017.

During a search of his person, a marijuana smoking device was located.

Gladney was jailed in lieu of $1,000 cash or bond bail.

He appeared in City Court on January 4, 2018.

 

 

Jacob J. Sponaugle, 18, of Liberty St., Batavia, is charged with DWAI/drugs, aggravated unlicensed operation 3rd, operating a motor vehicle without an inspection certificate, failure to keep right and unlawful possession of marijuana after a traffic stop on East Main street on December 29, 2017.

Sponaugle will appear in City Court on January 17, 2018 to answer the charges.

 

 

Frankie J. McQueen, 26, of Snipery Rd., Corfu, is charged with DWI, driving with a BAC of .08% or more, aggravated unlicensed operation 3rd and illegal signal after a complaint of erratic operation called in by another motorist on December 27, 2017.

Police located the vehicle on Thomas avenue and pulled McQueen over after he failed to properly signal a left turn.

McQueen was allegedly operating with a suspended license and will appear in City Court on January 10, 2018.

 

 

Levi Spikes Jr., 44, of Lewis Place, Batavia, is charged with unauthorized use of a motor vehicle, speed not reasonable and prudent, leaving the scene of a property damage accident, unlicensed operator and operating without insurance after a motor vehicle accident on Harvester avenue January 1, 2018.

Spikes was issued an appearance ticket and released, he will appear in City Court on January 9, 2018.

 

 

Derek J. Wert, 36, of Tracy Ave., Batavia, is charged with criminal contempt 2nd and harassment 2nd after an incident at TF Browns at 214 East Main street on December 31, 2017.

Wert had contact with a person in violation of a complete stay away order of protection and struck another person in the face.

Wert will appear in City Court on January 9, 2018.

 

 

Zachary J. Marrow, 26, of Seven Springs Rd., Batavia, was arrested December 24, 2017 by a Genesee County Sheriff’s Department Deputy on two arrest warrants for failure to appear after being served subpoena’s.

Marrow is charged with criminal contempt 2nd and was arraigned in City Court and re-appeared on January 3, 2018.

 

Samuel A. Torrelli, 24, of Stage Rd., Albion, is charged with unlawful possession of marijuana and inadequate headlights after a traffic stop on East Main street on December 28, 2017.

Torrelli was allegedly found to be in possession of marijuana in a vehicle.

He was released on an appearance ticket and will appear in City Court on January 9, 2018.

 

 

Alicia M. Gomez, 42, of S. Main St., Batavia, was arrested on a bench warrant December 26, 2017, stemming from a complaint of a violation of probation that occurred in February of 2017.

Gomez was jailed on $2,500 cash bail or $5,000 bond bail and is to re-appear in court on February 15, 2018 .

 

 

Devon D. Rodgers, 30, of Pearl St., Batavia, was arrested on an active bench warrant out of City Court on January 2, 2018.

Rodgers allegedly violated the terms of his conditional release from November 28, 2017 and a warrant was issued.

Rodgers was arraigned in City Court and was released pending a court date on January 3, 2018.
