BATAVIA/Troopers arrest man for DWI, calls for ride and the driver providing the ride is also charged with DWI

 

Troopers stopped Jay Markle, 60, of Batavia, for speeding on Rt. 33 in Bergen on February 12, 2018.. Markle was placed under arrest for DWI after failing field sobriety tests. He was processed at State Police Batavia where he provided a breath sample of .12% BAC. He was released on tickets returnable to the Town of Bergen Court.

Markle then called Darlene Martaus, 58, of Batavia, to come pick him up at the barracks. When Martaus arrived at State Police, Batavia, Troopers could detect the odor of alcoholic beverage and had Martaus perform field sobriety tests. Martaus was subsequently arrested for felony DWI, aggravated unlicensed operation 1st, operating a vehicle without an interlock device, and other vehicle and traffic charges. She provided a breath sample of .12% BAC. Martaus was arraigned and remanded to the Genesee County Jail.
