UPDATE: The Batavia Police responded to Subway at 412 E. Main Street in the City of Batavia for a reported robbery.
The defendant, Ricky L Miller II, no age provided, demanded and secured money from the business, then fled on foot.
Miller was located a short time later at a nearby residence.
When located, Miller was illegally in possession of a hypodermic instrument.
Miller was arrested for robbery 3rd, petit larceny, and possession of a hypodermic instrument.
Genesee County Sheriff’s Deputy Erion and K-9 Destro assisted with tracking Miller.
Miller was arraigned at Batavia City Court and remanded to the Genesee County Jail . He will return to Batavia City Court on January 17, 2017.

The Subway store on East Main street was robbed about 8:30 Saturday night.
According to Det. Sgt. Todd Crossett with the Batavia Police Department, a male subject entered the store and demanded money from the person working behind the counter.
The male subject received an amount of money, under $1,000, and fled on foot.
K-9 Destro and Deputy Christopher Erion were then requested to the scene to track the suspect.
Within 30 minutes, K-9 Destro and Deputy Erion found the male subject at a location on Swan street.
He was then taken into custody and arrested.
He is being charged with robbery and petit larceny in the incident.
No one was injured and it is believed there were no customers in the store at the time.
“If we didn’t have the K-9 it would have been more difficult to find out what way he went, says Crossett.
The male subject in custody will be arraigned in a few hours.
