Ann M. Capuano, 32, of Montclair Ave., Batavia, is charged with burglary 3rd, menacing 3rd, criminal trespass 3rd, possession of burglar tools and criminal mischief 4th after a reported burglary at Scalia’s Landscape at 8106 State Street road on April 8, 2017 at 8:00a.m.
While deputies were in route to the scene, Capuano was located leaving the area along State Street road on her bicycle and was stopped for questioning in the investigation.
After the investigation, it was discovered that Capuano entered the business causing damage inside. She also threatened staff at Scalia’s with a knife when they found her and told her to stay for the arrival of law enforcement.
Capuano was arraigned in the Town of Batavia Court on the burglary 3rd charge and remanded to the Genesee County Jail in lieu of $5,000 bail.
She was issued appearance tickets for the criminal mischief 4th, possession of burglar tools, menacing 3rd and criminal trespass 3rd charges. Capuano was also issued a traffic ticket for failure to keep right on a bicycle.
She will return to the Town of Batavia Court on April 17, 2017 at 12:30p.m.

The incident was investigated by Inv. Diehl, Deputy Erion, Deputy Cummings and Deputy Ferrando with assistance from several members of the City of Batavia Police Department.
Charles “Gusto” Thigpen Williams, 38, of S. Spruce St., Batavia, is charged with criminal sale of a controlled substance 3rd and criminal possession of a controlled substance 3rd, both class B felonies, after he was arrested on Saturday morning on a Genesee County Grand Jury Indictment warrant by Genesee County Drug Task Force members.
Williams allegedly sold crack cocaine at a location in the City of Batavia.
He will be arraigned in Genesee County Court later today.
Task Force members were assisted in the investigation by the Genesee County District Attorney’s Office.
