WYOMING COUNTY SHERIFF’S REPORT/Batavia man arrested after ongoing thefts of electronics and computer items at Walmart, two arrested for being found with meth lab equipment in car and teen charged under Leandra’s Law

A Batavia man was arrested following the investigation of ongoing thefts of electronic and computer items from the Warsaw Walmart on June 20, 2018.

Donald Stahl, 37 ,of North Street, Batavia, is charged with petit larceny, grand larceny 3rd and 4th  degree and (3) counts of conspiracy.

Stahl was arraigned in the Town of Warsaw by Justice Errington and was committed to the Wyoming County Jail on $5000 bail. Stahl is scheduled to appear back in the Town of Warsaw Court at a later date.

The investigation is on-going and additional arrests are pending.

Sgt. Colin Reagan, Deputy Aaron Chase and Genesee County Sheriff’s Inv. Chris Parker, Deputy Erik Andre, and Sgt. Jason Saile along with Walmart Asset Protection employees all assisted with the investigation and arrest.

 

 

The Wyoming County Sheriff’s Office announces the arrest of two individuals following an April 11, 2018 traffic stop on North Main Street in the Village of Warsaw.

Colin L. McMurtry was the driver of a 2005 Buick LeSabre which was stopped on North Main Street near State Street.

During the traffic stop, McMurtry was arrested for driving with eight active suspensions on his driver’s license. McMurtry was found to be in possession of methamphetamine on his person following his arrest. A subsequent vehicle search revealed components used for manufacturing methamphetamine in the trunk, and over two ounces of a liquid preparation of methamphetamine were located with the laboratory equipment in the trunk. The liquid was sent to the New York State Police Crime Laboratory for testing.

On June 20, 2018, an arrest warrant for Colin McMurtry was executed at his residence, and he was taken into custody. McMurtry was charged with the following:
Criminal Possession of a Controlled Substance in the Second Degree – Class A-II Felony
Unlawfully Manufacturing Methamphetamine in the Third Degree – Class D Felony
Criminal Possession of a Controlled Substance in the Seventh Degree
Aggravated Unlicensed Operation in the Second Degree, Third Degree, and Unlicensed Operator

Colin McMurtry was held in the Wyoming County Jail without bail.

Lea M. Falcone, a passenger in the vehicle, was charged with the following:
Unlawfully Manufacturing Methamphetamine in the Third Degree – Class D Felony

Falcone was held in the Wyoming County Jail in lieu of $5,000.00 cash bail or $10,000.00 bond. Falcone has since posted bond and has been released. Warsaw P.D., NYSP-Warsaw and NYSP CCSERT (Contaminated Crime Scene Emergency Response Team) assisted in the above investigation.

 

 

An 18 year old male was arrested by Wyoming County Sheriff’s Deputies following a traffic stop on Route 63 in the Town of Covington.

On June 20, 2018 at 10:55pm, the male was stopped for speeding at a rate of 76mph in a 55mph speed zone.

The male was found to have four other passengers in his vehicle ranging from ages 15 to 18. He was found to be in possession of 32.38 grams of marihuana, and it was determined through investigation that the vehicle occupants had been smoking marihuana while traveling on the roadway.

The 18 year old male driver failed roadside field sobriety testing, and he was subsequently taken into custody. The vehicle was towed from the scene, and all four other vehicle occupants were released into the custody of their respective parents.

The 18 year old male operator, whose name is not being released due to possible youthful offender status, was taken to the Wyoming County Sheriff’s Office. He was evaluated by Deputy Amy Nowak, a NYS Certified Drug Recognition Expert, who determined the male was impaired by cannabis and unable to operate a vehicle safely.

The 18 year old male is charged with one class E felony, Aggravated DWI – Child in Vehicle (Leandra’s Law), along with Driving While Ability Impaired by Drugs, Endangering the Welfare of a Child (2 counts), Criminal Possession of Marihuana in the Fifth Degree, Speed Over 55MPH, Unauthorized Stickers on Rear Windshield, and Unsafe Turn Without Signal.

The teen was processed and then released into the custody of a family member with an appearance date scheduled in the Town of Covington Court on July 16, 2018.
