Antwan Odom appeared in City Court this morning with a new attorney and a new haircut.
Attorney Frank Housh was retained by Odom’s family, who filled the court room to support Odom at his appearance today.
Basketball Coach Buddy Brasky also sat with Odom’s family in support of the teen as his attorney demanded his release from jail, based on the fact the people have 5 days or 120 hours from the time of his arraignment(on Sunday) to run a preliminary hearing if they want to keep him in custody on a felony charge.
On Monday, Odom appeared with Public Defender Michael Locicero who waived the preliminary hearing.
In today’s appearance, Housh requested a preliminary hearing and was granted one. It is scheduled for City Court on Monday at 10:00a.m.
Housh then requested his client be released under supervision, saying he was not a flight risk.
Odom is being held on $50,000 cash bail and $100,000 bond bail.
The bail was increased after Monday’s appearance when it was discovered that Odom is facing a felony charge of aggravated DWI/driving with children under the age of 16 in the car and a misdemeanor charge of impaired by drugs in the Town of Sweden Court. The case is still ongoing in the Town of Sweden Court and Odom has not been convicted in the incident.
“You were not here when bail was discussed, ” said Judge Balbick.
“He has a Leandra’s Law felony charge and in this case a C violent felony and the released under supervision platform is inappropriate here.”
Housh argued , “The fact that you are using an arrest that has no conviction should not count, you are assuming he is guilty and using that to punish him.”
Odom is charged with attempted assault 1st , a class C felony, and Criminal Possession of a Weapon 4th , class A misdemeanor after a report of a physical altercation which resulted in a subject being stabbed. Officers responded to the area of 153 Ross street and located the victim, Raymond L. Leach inside his residence with multiple lacerations from a cutting object. Leach identified the suspect as his neighbor and classmate, Antwan Odom. Leach indicated the altercation came after Leach accused Odom of stealing personal property. Leach was transported to Strong Memorial Hospital by ambulance for non-life threatening injuries. Leach was released a short while later after receiving treatment.
In court, Housh says his client was jumped by the victim and attacked. Odom suffered a concussion in the incident.
“He lost the race to the courthouse,” says Housh.
Judge Robert Balbick denied the request to the release Odom.
Housh says he will appeal the increase in bail in Genesee County Court.
