On September 3, 2018, the Albion Police Department arrested Kevin J. McMullen at his residence located at 12394 West Lee Road in the Town of Albion. The Orleans County Sheriff’s Office assisted the Albion Police in taking McMullen into custody.
The arrest comes after a 9 month investigation conducted by the Albion Police Department, Orleans County Major Felony Crime Task Force, Orleans County District Attorney’s Office and the Monroe County Medical Examiner’s Office.
McMullen, 32, was arrested in connection with the death of his wife, Megan McMullen, age 33. Megan McMullen died on December 18, 2017 at 346 West State Street in the Village of Albion as a result of an overdose of the Opiate Fentanyl.
The investigation revealed that Kevin McMullen transported Megan to the City of Rochester where he provided Fentanyl to her. Megan subsequently overdosed on the Fentanyl causing her to go into respiratory arrest. Kevin McMullen then performed rescue breaths on Megan until she began breathing. Kevin McMullen then transported Megan back to their residence at 346 West State Street in Albion where Megan again overdosed on the Fentanyl that Kevin had given her. Megan then went into cardiac arrest. Kevin McMullen then administered CPR on Megan. Kevin then instead of calling 911 to get medical assistance for Megan, injected the Fentanyl into himself. Kevin McMullen then called 911 several hours later. When the Albion Police and ambulance staff arrived, Megan McMullen was found to be deceased and beyond the time frame of lifesaving medical intervention.
Kevin McMullen is charged with criminal possession of a controlled substance 3rd with intent to sell, a class B felony, for providing Megan McMullen with the lethal fentanyl and criminally negligent homicide, a class E felony, for providing the lethal fentanyl which caused her death and not getting her the medical assistance which could have saved her life.
McMullen was arraigned in the Town of Albion Court and placed in the Orleans County Jail on $50,000.00. He is to return to court on September 7, 2018.
As a result of this investigation by the Albion Police and Orleans County Major Felony Crime Task Force, several dealers of the deadly opiates fentanyl and heroin were identified in the City of Rochester. These dealers were supplying Orleans County and responsible for several overdoses and possibly other overdose related deaths. Several arrests have been made and quantities of the deadly opiates taken off the streets.
The Albion Police Department is committed to do anything it can to battle the ongoing Opiate Epidemic. Although this arrest and investigation has aided in our efforts, we as a community must work at every level to save lives and prevent further tragedies. Arrest is a tool but other tools must be used to fight this battle. Prevention, education and awareness are critical components and we must always keep focused on the goal of conquering this deadly epidemic.
