Two men are facing charges after a vehicle stop on Lake Street in the Village of Perry.
At about 2:26a.m., January 18, 2019, Officer Smith observed a vehicle at Crosby’s in the village with the rear tail light broken out. Officer Smith observed the vehicle pull out onto Lake Street and conducted a traffic stop.
Noah Nelson, 19, was operating the vehicle and appeared to allegedly be under the influence. Nelson is charged with driving under the influence of drugs/driving under the influence of drugs-special category, broken tail lamp and refusing to submit to a urine sample after a Drug Recognition Expert evaluation.
During the investigation, 40 grams of marijuana was uncovered along with Xanax pills and a simulated handgun which turned out to be a BB gun that was found under the passenger seat.
Justin Dake, 21, of Brockport, NY, formally of Perry, admitted the drugs were his. Dake is charged with criminal possession of a controlled substance 7th, unlawful possession of marijuana and criminal possession marijuana 4th degree.
Dake was released on an appearance ticket and Nelson was remanded to the Wyoming County Jail. Both are to appear in Perry Court at a later date. A third person in the vehicle was not charged. Officer Smith was assisted at the scene by the New York State Police.
