A Genesee County Grand Jury has indicted Guillermo Torres- Acevedo, 23, of Batavia, after allegedly taking a 14-year-old Byron girl to Pennsylvania on November 29, 2018, causing an Amber Alert and manhunt.
In count 1, Acevedo is accused of rape 2nd, a class D violent felony, after engaging in sexual intercourse with another person less than 15 years old sometime during the month of October 2018 at or near the Country Meadows Manufactured Home Community in the Town of Batavia.
In count 2, Acevedo is accused of rape 2nd, a class D violent felony, after engaging in sexual intercourse with another person less than 15 years old sometime during September or October 2018 in Genesee County. This was on an occasion other than the ones referred to in counts 1 and 3.
In count 3, he is accused of rape 2nd, a class D violent felony, after engaging in sexual intercourse with another person less than 15 years old sometime during the month of October 2018 in the parking lot of the Days Inn in the Town of Batavia.
In count 4, Acevedo is accused of rape 2nd, a class D violent felony, after engaging in sexual intercourse with another person less than 15 sometime between November 25, and 26th 2018 in the Town of Batavia.
In count 5, Acevedo is accused of criminal sexual act 2nd, a class D violent felony, after engaging in oral sexual conduct with another person less than 15 years old sometime during October or November of 2018 in the Town of Batavia.
In count 6, he is accused of criminal sexual act 2nd, a class D violent felony, after a second occasion of engaging in oral sexual contact with another person less than 15 during October or November of 2018.
In count 7, Acevedo is accused of criminal sexual act 2nd, a class D violent felony, after engaging in oral sexual conduct with another person less than 15 years old on a third occasion sometime in October or November of 2018.
In count 8, Acevedo is accused of the crime of criminal sexual act 2nd, a class D violent felony, after engaging in oral sexual conduct with another person less than 15 years old sometime between November 25 and 26th 2018 in the Town of Batavia.
In count 9, he is accused of the crime of kidnapping 2nd, a class B violent felony after abducting another person on or about November 29, 2018 in the Town of Bergen.
In count 10, Acevedo is accused of the crime of criminal contempt 2nd, a class A misdemeanor, for intentionally disobeying or resisting a lawful process or other mandate of a Court by being in the physical presence of a person with a stay away order of protection against him.
In count 11, he is accused of endangering the welfare of a child, a class A misdemeanor, after knowingly acting in a manner likely to be injurious to the physical, mental or moral welfare of a child less than 17 years old between September 1st and November 29, 2018.
In count 12, Acevedo is accused of custodial interference 1st, a class E felony, after taking or enticing a child from her lawful custodian and with intent to permanently remove the victim from this state, knowing he had no legal right to do so, he removed the person from the state.
In count 13, Acevedo is accused of unauthorized use of a vehicle 3rd, a class A misdemeanor, knowing that he did not have consent of the owner, took and operated, exercised control over, rode in or otherwise used a 2012 Dodge Journey motor vehicle on November 29, 2018 in the Town of Batavia.
