GENESEE COUNTY/Pair pulled over at Batavia thruway exit in larceny incident a few days ago, arrested for stealing a vehicle overnight

Kyle A. Hawley, 29, of S. Lake St., Bergen, and Marissa A. Brennan, 26, of Townline Rd., Byron are each charged with grand larceny 2nd, a felony, criminal possession of a controlled substance 7th, criminal possession of a hypodermic instrument, criminally using drug paraphernalia, criminal mischief 4th and aggravated unlicensed operation 3rd(Hawley only) after allegedly stealing a vehicle from 4120 West Main street road in Batavia in the overnight hours of July 10th and 11th.

Both subjects were observed on Friday morning in the Village of Bergen and left the area prior to patrol’s arrival.

Both subjects were located in the Village of Churchville still inside the vehicle.

Both were also allegedly found in possession of drugs, paraphernalia and other possible stolen items. They also allegedly damaged the inside of the vehicle prior to it being recovered.

Both were arraigned in the Town of Batavia Court on July 12, 2019 and were remanded to the jail.

Hawley $15,000 cash/bond bail and Brennan $10,000 cash/bond bail.

Both subjects will re-appear in court on July 22, 2019 at 1:00p.m.

The investigation is ongoing.

The incident is being investigated by Deputies Kevin McCarthy and David Moore, assisted by Deputy Richard Schildwaster, Sgt. Michael Lute, Genesee County Drug Task Force, Investigator Chris Parker, Chief Deputy Joe Graff and members of the Monroe County Sheriff’s Office.

Previously:

Kyle A. Hawley, 29, of S. Lake Ave., Bergen, is charged with two counts of criminal possession of a controlled substance 7th, possession of a hypodermic instrument and criminally using drug paraphernalia 2nd after being pulled over in a larceny incident at the NYS Thruway entrance on July 10, 2019 at 8:10a.m.

Hawley was a passenger in the vehicle and after a search of the vehicle where stolen property was observed in plain view, Hawley was found to possess two different kinds of controlled substances, a hypodermic instrument and additional drug paraphernalia.

Hawley was processed at the Genesee County Jail and released on appearance tickets.

He will appear in the Town of Batavia Court on July 25, 2019 at 1:00p.m.

State Police also charged the driver, Walter T. Snell, 31, of Walnut St., Batavia in the incident.

Snell is charged with criminal possession of a controlled substance 7th, aggravated unlicensed operation 2nd, 3 suspensions, and operating a motor vehicle impaired by drugs 1st.

Snell is being held on bail/bond.

A second passenger in the vehicle, Marissa A. Brennan, 26, of Byron is charged with criminal possession of a controlled substance 7th and was issued and appearance ticket.

The investigation was assisted by members of the NYS Police and the City of Batavia Police Department.
