A Genesee County Grand Jury has indicted Benjamin Santiago Jr., 30, of Batavia in a burglary/robbery/assault/larceny that occurred on June 2, 2019 at 216 Ellicott street.
In count 1, Santiago Jr. is accused of robbery 1st, a class B violent felony, after forcibly stealing property from another person and during the commission of the crime he threatened the use of a dangerous instrument, a hammer.
In count 2, he is accused of robbery 1st, a class B violent felony, after forcibly stealing property and during the commission of the crime he caused serious physical injury to a person who was not a participant in the crime.
In count 3, he is accused of assault 1st, a class B violent felony, having intent to cause serious physical injury to another person and then causing such injury to that person by using a dangerous instrument, a hammer.
In count 4, Santiago Jr. is accused of grand larceny 4th, a class E felony, after stealing a credit or debit card belonging to the victim.
In count 5, he is accused of petit larceny, a class A misdemeanor, after stealing cash from the victim.
In count 6, Santiago Jr., is accused of petit larceny after stealing a bicycle from 350 Bank street on June 2, 2019.
In count 7, he is accused of burglary 2nd, a class C violent felony, for knowingly entering a dwelling at 8311 Bank street in the Town of Batavia with intent to commit a crime.
In count 8, Santiago Jr. is accused of grand larceny 3rd , a class D felony, after stealing a 2010 Ford F150 Lariat super cab truck from 8311 Bank street road on June 2, 2019.
