Benjamin Santiago Jr., 31, of Batavia pleaded guilty in Genesee County Court Wednesday afternoon in a burglary/robbery/assault/larceny that occurred on June 2, 2019 at 216 Ellicott street.
When the victim refused to give Santiago money at 216 Ellicott street, he allegedly hit him with a hammer several times, causing serious physical injury to the victim. Santiago then stole items in the residence.
Santiago left the scene, and then stole a bicycle on Main street. Santiago then stole a 2010 Ford F150 pick up truck on Bank street road in the Town of Batavia.
Rochester Police located Santiago and recovered the stolen vehicle.
Today he appeared with his attorney Greg Colavecchia and accepted the plea with the stipulation that if he pleads guilty to the entire eight count indictment, sentencing would be capped at 20 years with 5 years of post release supervision. The minimum he could face would be eight years.
Santiago pleaded guilty to two counts of robbery 1st, a class B violent felony, assault 1st, a class B violent felony, grand larceny 4th, a class E felony, after stealing a credit card, two counts of petit larceny, a class A misdemeanor, and burglary 2nd, a class C violent felony.
Santiago Jr. will be sentenced as a second felony offender as he was previously convicted of bail jumping 2nd and criminal possession of a controlled substance 5th in November of 2012.
With a previous conviction for bail jumping, Santiago will continue to be held on $100,000 cash or $200,000 bond bail.
He will be sentenced on December 5th at 2:00p.m.
