A Genesee County Grand Jury has indicted Morgan L. Cox Jr., 27, of Hutchins Place, Batavia, and accuses him of menacing a police officer, a class D violent felony.
On September 28, 2019 in the City of Batavia, Cox intentionally placed or attempted to place a police officer in reasonable fear of physical injury, serious physical injury, or death by allegedly displaying a knife while the officer was in the course of performing their duties.
In count 2, Cox is accused of menacing 1st degree, a class E felony, in the same incident on September 28th. He is accused of intentionally placing another person in fear of physical injury or death by displaying a dangerous instrument, a knife.
In count 3, Cox is accused of criminal possession of a weapon 3rd, a class D felony, in the same incident for allegedly possessing a dangerous instrument, a knife, with intent to use it unalwfully against another person.
In count 4, the Grand Jury further accuses Cox of the crime of obstruction of governmental administration 2nd, a class A misdemeanor, in the same incident. Cox allegedly intentionally obstructed, impaired or prevented an administrator of law or other governmental function from performing an official function by means of intimidation, physical force or interference by means of an unlawful act.
Cox Jr. was previously convicted of menacing 2nd, a class A misdemeanor, in the City of Batavia, which forms the basis for counts 2 and 3 in the current indictment.
