BATAVIA POLICE REPORT/Lancaster man takes money for HVAC work, but does not complete the job

Nicholas J. Durkin, 38, of Drullard Ave., Lancaster, is charged with grand larceny 4th, a class E felony, and grand larceny 3rd, a class D felony, while at Batavia City Court for a separate matter on December 5, 2019.

Durkin allegedly took $4,900 to perform HVAC work at a local business on Washington avenue on June 19, 2019. After receiving payment, Durkin never completed the work.

He was arraigned in City Court in front of Judge Balbick.

Durkin pleaded not guilty and was released on recognizance.

Nicholas A. Gaudy, 27, of Summit St., Batavia, is charged with DWI, aggravated DWI, driving with a BAC of .18% or more and refusal to take a road side breath test following a civil complaint on East Main street on December 4, 2019.

Gaudy was processed at the Jail and released on appearance tickets.

He is scheduled to appear in court on December 18, 2019 at 9:00a.m.

Teresa M. Stephenson, 30, of Cedar St., Batavia, is charged with petit larceny after allegedly shoplifting from Tops Supermarket at 390 West Main street on December 5, 2019.

Stephenson was released with an appearance ticket and will appear in City Court on December 17, 2019 at 1:00p.m.
