Calvin J. Rodriguez, 40, of Hillside Ave., NY,NY, is charged with criminal contempt 2nd, obstructing governmental administration, two counts of criminal possession of a controlled substance 7th, criminally using drug paraphernalia 2nd and possession of a hypodermic instrument after an investigation into a violation of an order of protection on Ellicott street on February 24, 2020.
Rodriguez allegedly made threatening gestures to the protected party, acting in a manner contrary to the provision set forth in the order of protection.
While being interviewed by deputies, Rodriguez attempted to flee and resist deputies as they attempted to perform their lawful duty. He was eventually taken into custody.
The investigation then led to the execution of a search warrant of an address on Park road. Following the execution of the search warrant, methamphetamine, prescription medications and drug paraphernalia was located, which Rodriguez is alleged to have possessed.
He was arraigned the next day in City Court and was remanded to the custody of the Genesee County Sheriff in lieu of cash bail and /or bond bail, as criminal contempt 2nd is a qualifying offense under the new bail reform law.
He is scheduled to appear in City and Town Court at a later date to answer the charges.
Rodriguez was also charged with petit larceny after an incident at Kohls on June 8, 2018 on Veteran’s Memorial Drive. He was issued an appearance ticket and will appear in Batavia Town Court on March 5, 2020 at 1:00p.m.
Assisting in the investigation were members of the Genesee County Drug Task Force, Genesee County Sheriff’s Sgt. Michael Lute, Deputy Brock Cummins, Batavia Police along with the District Attorney’s Office.
