Steven T. Foisset, 22, of Attica, was arrested following a motor vehicle accident on Maxon Road in the Town of Bennington on February 23, 2020.
Sergeant Jorgensen and Deputy Nowak responded to a call of a rollover accident with injuries. Bennington and Varysburg Ambulances responded to the scene and transported one injured passenger to Wyoming County Community Hospital.
During the investigation, Foisset failed roadside field sobriety tests and was placed under arrest for DWI. Foisset submitted to a breath test which showed his BAC to be above the legal limit.
Foisset is charged with DWI, driving with a BAC of .08% or more, speed not reasonable or prudent, and unsafe lane change. Foisset was issued appearance tickets and will appear in Bennington Town Court at a later date.
On February 20, 2020, Wyoming County Sheriff’s responded to Route 63, Town of Covington, for a reported motor vehicle accident with injury.
Upon arrival, it was discovered that a Kayla B. Allen, 34, of Warsaw was waiting to turn onto Court Road and was rear-ended. Allen was waiting on a westbound tractor trailer to pass by to make her turn. A second tractor trailer, operated by Randeep Sidhu of Ontario Canada, failed to stop and rear ended Allen’s vehicle. This caused Allen’s vehicle to be pushed forward and under the westbound tractor trailer, operated by Richard Witzel of LeRoy. This caused that trailer’s axles to break off Witzel’s trailer. Allen’s vehicle was demolished.
Allen was transported to Strong Memorial Hospital by Medic 80 for chest injuries. Witzel was transported to WCCH for back pain. All three vehicles had to be towed from the scene due to extensive damage.
Sidhu was charged with following too closely. He is to answer the charge in Covington Town Court at a later date.
Assisting the Wyoming County Sheriff’s Office at the scene, the New York State Police, Pavilion Fire, Medic 80, BLS1, Karson’s Garage, Stella’s towing, and T and R Collision.
On February 22, 2020 at approximately 2:51a.m., a Deputy from the Wyoming County Sheriff’s Office conducted a traffic stop on Cozy Road in the Town of Bennington after observing vehicle and traffic violations.
Upon speaking with the operator, Marcus Ciociola, 23, of Lackawanna, NY, the Deputy began to observe signs of impairment. A roadside DWI investigation was conducted, which included the performance of field sobriety testing.
Ciociola performed poorly on the field sobriety testing and was then requested to submit to a Drug Influence Evaluation. Following the evaluation, conducted by a certified Drug Recognition Expert, it was determined that Ciociola was allegedly impaired by drugs and unable to operate a vehicle safely.
He is charged with DWAI/drugs, uninspected motor vehicle, inadequate plate lamps, and unlawful possession of marijuana. Ciociola was issued an appearance ticket and released on recognizance. He will appear in the Town of Bennington court on March 9, 2020.
