On May 24, 2021 at about 7:29p.m., a deputy in a marked Sheriff’s Patrol vehicle observed a dark colored Pontiac sedan traveling north in Rt. 63 in Oakfield at a high rate of speed. The deputy then turned around and attempted to catch up to the vehicle, but it continued at a high rate of speed, passing a vehicle in the southbound lane.
The deputy then turned on the patrol vehicle’s emergency lights and sirens, but the vehicle failed to stop .
The vehicle continued on, turning east onto Rt. 262 and then north on Fox road, still failing to yield to the Sheriff’s vehicle. At the intersection of Fox road and Maltby road, while traveling at a high rate of speed, the vehicle passed through a stop sign and went into the air and off the north shoulder of Maltby road and into a field.
The Pontiac then struck a tree and continued driving northwest through the field.
A back seat passenger then jumped out of the moving vehicle in the field and then complied with the deputy’s commands. The vehicle continued northwest and entered a neighboring crop field, damaging about $1,000 worth of crops.
The Pontiac then stopped in the field and the two front seat occupants fled on foot.
Scales with residue and an illegal weapon were located in the vehicle.
A K-9 was then called in to assist with a search of the area and led deputies to a nearby residence where the residents told police that the two occupants were seen in the area and were given a ride to the Batavia Walmart on Lewiston road.
Law enforcement then responded to Walmart, locating the two occupants of the vehicle in the Walmart parking lot.
Jason M. Fitzpatrick, 38, of Sweet Rd., Howell, MI, the driver of the vehicle, is charged with criminal possession of a weapon 3rd, unlawful fleeing a police officer in a motor vehicle, criminal mischief 4th, obstructing governmental administration 2nd and aggravated unlicensed operation 3rd. Fitzpatrick was also wanted out of Michigan for being a Parole absconder
Fitzpatrick appeared in County Court on May 25, 2021.
A front seat passenger, Samantha R. Makar, 22, of W. Madison St., York, SC, is charged with obstructing governmental administration and criminal possession of a weapon 4th. She will appear in Oakfield Town Court on June 14, 2021 at 6:00p.m.
The third occupant was released without any charges after complying with deputies.
The Sheriff’s Office was assisted by the NYS Police, NYS DEC K9 unit and the City of Batavia Police Department.
