GENESEE COUNTY SHERIFF’S REPORT/Man charged with forcible touching at local hotel parking lot/High speed pursuit leads to charges for N. Chili man

Thomas M. Bergman, 22, of Park Rd., Batavia, is charged with forcible touching, following an investigation into an incident that allegedly occurred at the Relax Inn on Park road in the Town of Batavia on August 1, 2021 at 12:49a.m.

Bergman allegedly forcible touched the intimate parts of a female Uber driver while in the parking lot of the Relax Inn.

Bergman was arraigned in the Town of Batavia Court and released on his own recognizance. He is scheduled to appear in Batavia Town Court on August 24, 2021 at 2:00p.m.

James M. Lepore, 23, of Rio Grand Dr., North Chili, NY, is charged with reckless endangerment 1st, criminal possession of a firearm, unlawful fleeing a police officer 3rd, criminal possession of a controlled substance 7th, and speed in excess of 55mph, following a vehicle pursuit after a deputy attempted to complete a traffic stop on Rt. 33 in Stafford for speeding in excess of 55mph.

The pursuit began on Rt. 33 in the town of Stafford and continued into the town of Batavia, city of Batavia and ended on Rt. 98 in the town of Elba, after a Stinger Spike System was successfully deployed.

Lepore allegedly recklessly engaged in conduct which created a grave risk of death by unlawfully fleeing a deputy in a motor vehicle and intentionally driving into the opposite lane of travel, causing other motorists to swerve out of the way to avoid a head on collision, all while traveling at speeds of 90-100mph.

Lepore was also allegedly in possession of an unregistered firearm and a controlled substance. He was charged with a total of 21 traffic offenses.

Lepore was arraigned in the town of Batavia Court and released on his own recognizance.

The case is being handled by Deputy DeMuth and Investigator Forsyth.

Assisting in the incident was Sgt. Andrew Hale, Investigator Carlson, Investigator Loftus, Investigator DeLong, Deputy Krzemien, Deputy Brabon, Deputy Tower, Deputy Mullen, K-9 Frankie, City of Batavia Police Department and the NYS Police.
