GENESEE COUNTY/Indictments

Kevin H. Ayers has been indicted by a Genesee County Grand Jury and is accused of criminal mischief third degree, a class E felony, on or about October 8, 2021, in the Town of Pembroke, after allegedly damaging property of another person in an amount exceeding $250, a rear driver’s side tire, door and fender of a Ford pickup truck belonging to another person.

In count 2, Ayers is accused of criminal obstruction of breathing or blood circulation, a class A misdemeanor, after allegedly applying pressure on the throat or neck of another person, impeding normal breathing on the same above date and location.

In count 3, the indictment further accuses Ayers of menacing second degree, a class A misdemeanor, after allegedly displaying a dangerous instrument, a knife, placing the victim in reasonable fear of physical injury or death on the same above date and location.

In count 4, Ayers is accused of harassment second on the same above date and location, subjecting the victim to physical contact.

Zachary P. Hursh has been indicted and is accused of criminal possession of stolen property third degree, a class D felony, after allegedly knowingly possessing stolen property with a value exceeding $3,000 in Stafford on December 1, 2021.

In count 2, Hursh is accused of obstructing governmental administration second degree by preventing a public servant from performing an official function by means of intimidation, physical force or interference on the same above date and location.

In count 3, the indictment further accuses Hursh of unlawful fleeing a police officer in a motor vehicle in the third degree, a class A misdemeanor, on the same above date and location, driving at speeds which equaled or exceeded 25 miles per hour above the speed limit.

In count 4, Hursh us accused of reckless driving as a misdemeanor on Rt. 237 on the same above date in Stafford, NY, in a manner which interfered with the free and proper use of a public highway endangering the users of the public highway.

Joshua L. Webster has been indicted and is accused of the crime of criminal contempt first degree, a class E felony, after violating an order of protection on December 31, 2021, in the Town of LeRoy, and intentionally placed the victim in reasonable fear of physical injury, serious physical injury or death by displaying a dangerous instrument, a knife.

In count 2, Webster is accused of menacing second degree, a class A misdemeanor, on the same above date and location after placing the victim in fear of death or serious physical injury, in violation of an order of protection.

In count 3, Webster is accused of criminal possession of weapon third degree, a class D felony, on the same above date and location, and allegedly possessed a dangerous instrument, a knife, with intent to use it unlawfully against another.

In count 4, the indictment further accuses Webster of the crime of endangering the welfare of a child, a class A misdemeanor, on the same above date and location above. Webster knowingly acted in a manner injurious to the physical, mental or moral welfare of a child less than 17 years old.

In count 5, Webster is accused of endangering the welfare of a child, on the same above date and location above.

In count 6, Webster is accused of endangering the welfare of a child, on the same above date and location above.

in count 7, Webster is accused of criminal contempt second degree, a class A misdemeanor on March 29, 2022, in the Town of LeRoy, violating an active stay away order of protection.

In count 8, Webster is accused of criminal contempt first degree, a class E felony, On May 1, 2022, in the Town of LeRoy, Webster violated an order of protection after he intentionally placed or attempted to place the victim in fear of physical injury or death by displaying a deadly weapon, dangerous instrument, a belt.

Webster was previously convicted of the crime of burglary third degree, a class D felony, on June 28, 2012, in Genesee County Court. This conviction forms the basis for elevating count 3 of the indictment to criminal possession of weapon third degree.
