PERRY POLICE REPORT/Perry man jailed without bail, facing felony charges following a domestic incident

PERRY, NY- Chief Michael J. Grover reports the arrest of a Perry resident on several charges following an investigation by the Perry Police Department.

On October 17, 2022, at approximately 6:07 p.m., the Wyoming County 911 Center received multiple calls for the report of a possible domestic incident in the Village of Perry where callers were reporting possible injuries to a female.  

Sergeant Russell and Officer Kramell arrived on scene to find the parties outside of the residence and the female complaining of rib pain and having a difficult time breathing.  There were also obvious signs on both parties that some sort of physical altercation occurred.   The parties were separated, Perry ambulance was requested to the scene.

An investigation revealed that 37-year-old Michael D. Baker of Perry, was involved in a verbal argument with an adult female which escalated and eventually became physical when Baker allegedly kicked the female down a flight of stairs within the residence and began hitting and kicking her.  This resulted in a rib injury as well as several bruises, markings, and swelling.   It was also discovered that there is a current order of protection between Baker and the victim, where the victim is the protected party.  Based on the evidence at the scene, the female’s injuries, as well as interviews that were conducted; Baker was placed into custody.

After Baker was placed into custody and searched, officers discovered loose orange pills, not in a prescription container.  The pills were identified as dextroamphetamine (Adderall) and are a controlled substance.  Baker was unable to provide any proof or documentation showing that he was in fact the prescribed individual and was to be in possession of the pills after being given several opportunities to do so.  

Baker was transported to the Perry Police Department where he was further interviewed and processed.

He is charged with criminal contempt 1st degree, a class E felony, aggravated family offense, assault 2nd, degree, a class D felony and criminal possession of a controlled substance 7th degree.

Baker was arraigned in Perry Village Court before Judge Miller where he was committed to the Wyoming County Jail without bail due to pending felony level charges. Baker also has multiple felony convictions from previous incidents.  

The female victim was transported to Wyoming County Community Hospital for evaluation and treatment.  The Wyoming County District Attorney’s Office was also consulted for the investigation.  Baker is due back in Perry Village Court on November 8, 2022.
