The Batavia Town Board passed a resolution on Wednesday evening to enter into an agreement with 570 DAB 30, LLC (Benderson Development LLC) to install future sidewalks on Lewiston road between Park road and Veteran’s Memorial Drive.
Benderson Development is planning to build a 4,000 sq. ft. restaurant with a drive thru and a by-pass lane that will be located in the southwest corner of the old Kmart parking lot at 8363 Lewiston road. They will also construct a 6,752 sq. ft. retail/restaurant building with a 2,000 sq ft. end cap coffee shop with a drive thru to be located in the southeast corner of the premises.
The building and zoning approvals were granted by the Town of Batavia Planning Board, subject to the installation of sidewalks by the owner.
Deputy Town Supervisor Dan Underhill says, the developer agreed to pay for the installation of sidewalks on the north side of Lewiston road if a sidewalk district is formed by the Town of Batavia. Underhill says this is the first ever sidewalk district in the Town of Batavia. Currently, there is no schedule as to when the sidewalks will be installed as the forming of the sidewalk district is still being worked on by Town engineers. Underhill was unsure if sidewalks on the south side of Lewiston road will be included in the sidewalk district as businesses on that side of the road will have to be advised of the creation of the new sidewalk district.
