On Wednesday, November 30, 2022, Barrington Harvey, a 38-year-old Attica Correctional Facility inmate, pleaded guilty before the Honorable Michael M. Mohun to an Indictment charging him with assault second degree, a class “D” violent felony, and forcible touching, a class “A” misdemeanor.
Harvey faces up to 7 years in state prison with 5 years of post-release supervision on the assault 2nd conviction and up to 364 days in jail under the forcible touching conviction. Any sentence he receives will be run consecutive to his current prison term.
During the guilty plea, Harvey admitted that he intended to cause physical injury to an Attica Correctional Facility officer and caused injury to that officer. He also admitted that he “intentionally, and for no legitimate purpose, forcibly touched the sexual or other intimate parts of another person for the purpose of degrading or abusing such person or for the purposes of gratifying his sexual desire.”
Sentencing is scheduled for February 8, 2023 at 11:00 a.m.
“We continue to be committed to maintaining the safety and security of our correctional facilities and the men and women that work within them by prosecuting cases that occur within these facilities. The video of this incident shows clearly that this was an unprovoked attack on one of the female correctional officers within the facility. This sentence will send a message that this kind of behavior will not be tolerated,” said Wyoming County District Attorney Donald O’Geen.
