BATAVIA POLICE BLOTTER/March 14, 2023

Sarah A. Malone, 40, of Graham Street, Batavia, NY, is charged with theft of services and criminal impersonation second degree. On 2/21/2023, Officer Martinez arrested Malone on the above listed charges after it was alleged that she dined at a local restaurant and left without paying her bill. After being located by Batavia PD regarding the theft of services, Malone provided Batavia Police Officers with a false name and date of birth. Malone was issued an appearance ticket and was scheduled to appear in Batavia City Court on 3/7/2023 at 1:00 PM.

Brittany L. Hollaert, 26, of St. Paul Street, Rochester, NY, is charged with failure to appear. On 03/07/2023, Officer Post arrested Hollaert on two active arrest warrants out of Batavia City Court for attempted grand larceny in the third degree, petit larceny, and criminal trespass. Hollaert was released on her own recognizance and admitted to a drug treatment facility where her case will be handled by SAFE Court.

Douglas M. Ashworth, 48, of Vine Street, Batavia, NY is charged with menacing. On 2/28/2023, Officer Gombos arrested Ashworth for menacing after an investigation into an incident that took place on 10/09/2022. It is alleged that Ashworth pointed a hunting rifle at two juveniles and placed them in reasonable fear of physical injury or death. Ashworth was issued an appearance ticket and scheduled to appear in City Court at a later date.

Grant J. Fremstad, 22, of Ekern Street, Westby, Wisconsin, is charged with driving while intoxicated, aggravated driving while intoxicated with a BAC of .18% or more, improper lane usage, and open container. On 3/5/2023, at about 2:23 AM, Officer Weglarski stopped a vehicle on East Main Street for a traffic violation. The vehicle was allegedly being operated by Fremstad and upon further questioning and investigation it was determined that he was allegedly intoxicated and subsequently arrested for DWI. Fremstad is due to appear in Batavia City Court on 3/22/2023 at 9:00 AM.

Demetrio J. Watts, 38, of Eggert Road, Buffalo, NY, is charged with failure to keep right, failure to signal, and driving while intoxicated. On 03/05/2023, Officer Gombos arrested Watts after an investigation into a traffic stop. It is alleged that Watts was stopped for several moving violations and found to allegedly be intoxicated by alcohol with a BAC of .08% or more. Watts was arrested and issued an appearance ticket to appear in City Court at a later date.

Phillip D. Byford, 32, of Brockport Spencerport Road, Sweden, NY, was arrested on Batavia City Court bench warrants. On 3/2/2023. Officer Moscicki arrested Byford on bench warrants issued by Batavia City Court. The first warrant stemmed from an incident on 1/24/2020, at a business on W. Main Street, where Byford was charged with petit larceny and released on an appearance ticket after which he failed to appear. The second warrant was issued after Byford was arrested for petit larceny on 1/24/2020 after an incident on W. Main Street. He was issued an appearance ticket and failed to appear. The third warrant was issued on a criminal trespass second degree arrest after an incident on E. Main Street, where Byford was issued an appearance ticket and subsequently failed to appear. Byford was arraigned in Batavia City Court on 3/3/2023 at 3:30 pm and is to appear at a later date.

Myia N. Sobus, 19, of South Pearl Street, Oakfield, NY, and Timothy J. Alis,18, of Park Road, Batavia, NY are each charged with petit larceny. On 3/04/23. Officer Crossett arrested Sobus and Allis on the above charge.  It is alleged that they filled a shopping cart with $897 worth of items and left the store without paying.  They were released with an appearance ticket to appear in Batavia City Court on 3/14/23 at 1:00pm. 

Shawn M. Sloan, 38, of Porter Avenue, Batavia, NY, is charged with petit larceny and criminal trespass second degree. On 3/3/23, Officer Yung arrested Sloan on the above charges after it is alleged that he entered an apartment on Bank Street and stole a kitchen utensil.  Sloan was released on an appearance ticket to appear in Batavia City Court on 3/7/23.

Shannon B. Harder, 38, of Bowen Road, Attica, NY, is charged with unsafe turn, speed in zone, failure to keep right, and driving while intoxicated.  On 3/8/23, Officer Freeman arrested Harder for driving while intoxicated as well as other vehicle and traffic violations after a traffic stop on Cedar Street. Harder was allegedly speeding, failing to maintain her lane and driving while intoxicated. Harder was released on appearance tickets with a return date of 03-08-2023 at Batavia City Court.
