WYOMING COUNTY SHERIFF’S REPORT/June 15, 2023

On June 11th, 2023, at around 5:24am, deputies with the Wyoming County Sheriff’s Office responded to the area of Hermitage Road near Wethersfield Road, in the Town of Wethersfield, for the report of a vehicle parked in the middle of the roadway and the complainant believed the driver of the vehicle was intoxicated.

Once deputies arrived on scene, a red 2019 Ford F-150 was observed parked in the middle of the northbound lane and it appeared to be missing the front two tires and one of the rear tires was also flat. Gouge marks in the roadway were observed from where the vehicle had been driving on its rims, which also showed the vehicle had left the roadway off the east shoulder and also crossed the yellow center line several times.

Deputies met with the driver of the vehicle, Trevor G. Austin, 41, of Warsaw, NY, who was observed sitting on the shoulder of the roadway after the complainant pulled him from the vehicle.
While interviewing Austin, deputies suspected him to be intoxicated and began a roadside DWI investigation, which included standardized field sobriety testing. Following standardized field sobriety testing, Austin was placed under arrest for driving while intoxicated and transported to the Wyoming County Sheriff’s Office where he submitted to a Data Master DMT breath test. A data check of Austin’s license also showed he was suspended pending prosecution on another DWI he had been arrested for in November of 2022.

Austin was ultimately charged with aggravated unlicensed operation of a motor vehicle in the 1st degree, a felony, DWI, driving with a .18% BAC or greater, failure to keep right, moving from a lane unsafely, stop/stand/park on pavement and unsafe tires.

Austin was arraigned in the Town of Warsaw Court in front of the Honorable Judge Errington and was
released on his own recognizance, as none of the charges were qualifying offenses for bail. Austin is
scheduled to appear in the Town of Wethersfield Court at a later date. Deputies followed up on the route that Austin had driven and located the two missing tires. Based on the evidence, it was determined that Austin had driven roughly 10 miles on flat/no tires before coming to a stop.

Victor C. Cracknell, 51, of Buffalo, NY, was arrested following a traffic stop on Route 77 in the Town of
Bennington on June 14, 2023.

Cracknell was stopped for a traffic infraction, and upon approaching the vehicle,
law enforcement detected the odor of cannabis. Located inside the vehicle next to the driver,
were multiple containers of concentrated cannabis along with a plugged in, warm to the touch
concentrated cannabis vaping device.

Cracknell performed poorly on Standardized Field Sobriety testing, at which time he was placed under arrest for DWAI Drugs. Cracknell’s vehicle was towed from the scene, and Cracknell was taken to the Wyoming County Sheriff’s Office where he was evaluated by a Drug Recognition Expert.

Following the evaluation, Cracknell was determined to be impaired by drugs and unable to operate a vehicle safely.

Cracknell was subsequently charged with Driving While Ability Impaired by Drugs,
Consumption of Cannabis in a Motor Vehicle, and Obstructed Rear Plate. Cracknell was issued
an appearance ticket, and he was scheduled to answer the charges in the Town of Bennington
Court on June 26, 2023.
