On February 15, 2024, TODD WEIGERT appeared before Acting Wyoming County Court Judge Melissa Lightcap Cianfrini and pleaded guilty to the following charges:
CRIMINALLY NEGLIGENT HOMICIDE, a Class “E” Felony, and
CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE IN THE FIFTH DEGREE, a Class “D” Felony
The maximum sentence on the Criminally Negligent Homicide conviction is an indeterminate sentence of up to 4 years. The maximum sentence for the Criminal Possession of a Controlled Substance in the Fifth Degree is a 4 year prison sentence with two years of post-release supervision. The only agreement on sentencing is that the sentences must run concurrently with each other. As part of the plea agreement, Defendant waived his right to appeal.
Judge Melissa Lightcap Cianfrini held the Defendant without bail and adjourned the case for sentencing on March 14, 2024 at 11:30 a.m.
“This young woman’s death will unfortunately go on the list of the numerous people that have died in this country as a result of Fentanyl. Fentanyl is a synthetic opioid that is often mixed with another drug, as it was in this case. My Office expresses its condolences to the family of this young woman,” said First Assistant District Attorney Vincent A. Hemming.

PEOPLE v. TODD WEIGERT
Todd A. Weigert, 28, of Perry, New York was indicted by the Wyoming County Grand Jury on the charges of:
CRIMINALLY NEGLIGENT HOMICIDE
CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE IN THE THIRD DEGREE
CRIMINALLY USING DRUG PARAPHENALIA IN THE SECOND DEGREE
CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE IN THE SEVENTH DEGREE
Todd A. Weigert is alleged to have, with criminal negligence, supplied a narcotic drug to a 34 year old woman who then overdosed and died as a result. In addition, Todd A. Weigert is alleged to have possessed narcotic drugs with intent to sell them, possessed drug paraphernalia, and possessed another narcotic drug on a different date.
Todd A. Weigert faces a maximum sentence of 4 years on the Criminally Negligent Homicide and a maximum of 12 years on the Criminal Possession of a Controlled Substance in the Third Degree charge.
Todd A. Weigert was arraigned on December 21, 2023 before the Honorable Keith Kibler where bail was set at $15,000 Cash, $30,000 Bond, and $45,000 partially secured. The case is currently scheduled for February 15, 2024 at 1:30 p.m. for pre-trial motion arguments in Wyoming County Court.
The Perry Police Department and the New York State Police conducted the investigation in this case. The case is being prosecuted by First Assistant District Attorney Vincent A. Hemming. Jordan Humphreys, Esq. and Norman P. Effman, Esq. represented the Defendant.
