PERRY POLICE REPORT/Perry woman charged after two vehicle motor vehicle accident

PERRY, NY- Chief Michael J. Grover reports the arrest of a Perry resident following a DWI investigation by the Perry Police Department after a motor vehicle accident.

On March 20, 2024, at approximately 10:44 a.m., Officer Kramell was dispatched to the area of South Center Street and Leicester Street for the report of two car motor vehicle accident. Upon arrival and throughout the incident, one of the drivers, 28-year-old Kayla E. Harkins, was allegedly showing signs of intoxication.

During the investigation and through interviews, it was discovered Harkins allegedly failed to yield the right of way at the intersection and struck another vehicle traveling from North Center Street to South Center Street.

Harkins voluntarily submitted to Standardized Field Sobriety Testing at the scene where she performed poorly. Harkins was arrested and charged with DWI and transported to Perry Police Department, where she voluntarily submitted to a chemical breath test. The test revealed Harkins had a BAC of .26%. Furthermore, Harkins was driving with a child less than fifteen years of age in the vehicle, making the charge a felony.

Harkins was arraigned in Perry Village Court and represented by the Wyoming County Public Defenders Office where she was released to a sober third party, per NYS bail reform laws. Harkins is due back in Perry Village Court on 04/16/2024 at 1:00 p.m..

Vehicle and Traffic Law- 1192-3 DWI-Common Law

Vehicle and Traffic Law-11922-AA Aggravated DWI BAC .18% of 1% or higher

Vehicle and Traffic Law-11922-AB-Leandra’s Law DWI

Penal Law- 260.10- Endangering the Welfare of a Child
