GENESEE COUNTY/Deputy and homeowner exchange gunfire during burglary call, homeowner charged

The Genesee County Sheriff’s Office is investigating an incident that occurred at 7924 Lewiston Road in the Town of Batavia, New York.

On May 28, 2024, at about 3:51a.m., the Genesee County Emergency Dispatch Center received a call regarding a residential burglary at that residence. A preliminary investigation indicates that the initial Genesee County Sheriff’s Deputy who responded to the call was approaching the home when he confronted a subject outside the residence. The Sheriff’s deputy identified himself and the subject then fired a gun shot at the deputy. The deputy returned fire and continued to identify himself, however the subject continued to fire at the deputy.

During the exchange of gunfire, the deputy was able to obtain a position of cover and await backup. Upon a second deputy’s arrival, the subject was taken into custody without further incident. Neither the Deputy Sheriff nor the subject were struck by any of the gunfire. No injuries were sustained as result of the gunshots.

The subject was identified as the homeowner, Gregory Poole, age 81. He was taken to United Memorial
Medical Center for injuries unrelated to the exchange of gunfire with the deputy. Poole’s injuries were
believed to have been sustained during a struggle that he had engaged in with a burglary suspect. An
area search was conducted; however, the burglary suspect was not located and is believed to have fled
the scene prior to the deputy’s initial arrival.

Poole was released from the hospital and has been charged with Reckless Endangerment 1st degree and
Menacing a Police Officer. Poole was arraigned in the Genesee County Centralized Arraignment Part
Court and was released on his own recognizance. He was directed to appear in Batavia Town Court on
June 11, 2024 at 3:00PM.

The initial burglary incident along with this investigation are both ongoing active investigations, no further details will be released at this time.
