The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of SEXUAL ABUSE IN THE FIRST DEGREE, a class D violent felony, contrary to Penal Law Section 130.65(3), committed on or about and between October 7, 2011, and March 22, 2012, in the
Town of Alexander, in the County of Genesee:
At said time and place JOHN P. VOLPE, subjected another person to sexual contact when the other person was less than eleven years old.
COUNT TWO:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of SEXUAL ABUSE IN THE FIRST DEGREE, a class D violent felony, contrary to Penal Law Section 130.65(3), committed on or about and between March 22, 2012, and October 6, 2012, in the
Town of Alexander, in the County of Genesee:
At said time and place JOHN P. VOLPE, subjected another person to sexual contact when the other person was less than eleven years old.
COUNT THREE:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of AGGRAVATED SEXUAL ABUSE IN THE THIRD DEGREE, a class D violent felony, contrary to Penal Law Section 130.66(I)(d), committed on or about and between September 2017 through
October 6, 2018, in the Town of Alexander, in the County of Genesee:
At said time and place JOHN P, VOLPE, without a valid medical purpose, inserted his finger into the rectum of another person and when that person was less than thirteen years old.
COUNT FOUR:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of CRIMINAL SEXUAL ACT IN THE FIRST DEGREE, a class B violent felony, contrary to Penal Law Section 130.50(4), committed on or about and between October 7, 2018, and October 6, 2019, in the Town of Alexander, in the County of Genesee:
At said time and place, JOHN P. VOLPE, being eighteen years or more, did engage in oral sexual conduct with another person who was less than thirteen years old.
COUNT FIVE:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of COURSE OF SEXUAL CONDUCT AGAINST A CHILD IN THE FIRST DEGREE, a class B violent felony, contrary to Penal Law Section 130.75(I)(b), in the Town of Alexander, in the County of Genesee:
That, JOHN P. VOLPE, over a period of time not less than three months in duration, to wit: October 7, 2018, through October 6, 2019, being eighteen years old or more, engaged in two or more acts of sexual conduct, which included at least one act of deviate sexual intercourse, with a child less than thirteen years old.
COUNT SIX:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of PREDATORY SEXUAL ASSAULT AGAINST A CHILD, a class A-II Felony, contrary to Penal Law Section 130.96, committed on or about and between October 7, 2018, through October 6, 2019, in the Town of Alexander, in the County of Genesee:
At said time and place, JOHN P. VOLPE, being eighteen years old or more, committed the crime of Course of Sexual Conduct Against a Child in the First Degree and the victim was less than thirteen years old.
COUNT SEVEN:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of RAPE IN THE THIRD DEGREE, a class E felony, contrary to Penal Law Section 130.25(2), committed on or about and between October 7, 2022, through October 6, 2023, in the Town of Alexander, in the County of Genesee:
At said time and place, JOHN P. VOLPE, being twenty-one years old or more, engaged in sexual intercourse with another person less than seventeen years old.
COUNT EIGHT:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of RAPE IN THE FIRST DEGREE a class B violent felony, contrary to Penal Law Section 130.35(1), committed on or about and between October 7, 2022, and October 6, 2023, in the Town of Alexander in the County of Genesee:
At said time and place, JOHN P. VOLPE, engaged in sexual intercourse with another person without said person’s consent which lack of consent resulted from the use of forcible compulsion by JOHN P. VOLPE.
COUNT NINE:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of CRIMINAL SEXUAL ACT IN THE FIRST DEGREE, a class B violent felony, contrary to Penal Law Section 130.50(1), committed on or about and between October 7, 2021, and October 6, 2023, in the Town of Alexander, in the County of Genesee:
At said time and place, JOHN P. VOLPE, engaged in oral sexual conduct with another person, without said person’s consent which lack of consent resulted from the use of forcible compulsion by JOHN P. VOLPE.
COUNT TEN:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of AGGRAVATED SEXUAL ABUSE IN THE FIRST DEGREE, a class B violent felony, contrary to Penal Law Section committed on or about and between November 22, 2022, through
October 6, 2023, in the Town of Alexander, in the County of Genesee:
At said time and place JOHN P. VOLPE, without a valid medical purpose, inserted a foreign object into the vagina of another person causing physical injury to such person by forcible compulsion.
COUNT ELEVEN:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of SEXUAL ABUSE IN THE FIRST DEGREE, a class D violent felony, contrary to Penal Law Section 130.65(1), committed on or about and between October 7, 2013, through October 6, 2014, in
the Town of Alexander in the County of Genesee:
At said time and place JOHN P. VOLPE, subjected another person to sexual contact by forcible compulsion.
COUNT TWELVE:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of SEXUAL ABUSE IN THE FIRST DEGREE, a class D violent felony, contrary to Penal Law Section 130.65(1), committed on or about January 23, 2024, in the Town of Alexander, in the County
of Genesee:
At said time and place JOHN P. VOLPE, subjected another person to sexual contact by forcible compulsion.
COUNT THIRTEEN:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, JOHN P. VOLPE, of the crime of ENDANGERING THE WELFARE OF A CHILD, a class A misdemeanor, contrary to Penal Law Section 260.10(1), committed on or about and between June I, 2021, through October 6, 2023, in the Town of Alexander, in the County of Genesee:
At said time and place, JOHN P. VOLPE, knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.
