The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, MATTHEW J. MIRA, of the crime of TAMPERING WITH PHYSICAL EVIDENCE, a class E felony, contrary to Penal Law Section 215.40(2), committed on or about October 23, 2023, in the City of Batavia, in
the County of Genesee:
At said time and place, believing that certain evidence was about to be produced or used in an official proceeding or a prospective official proceeding and intending to prevent such production or use, suppressed it by any act of concealment, alteration or destruction, or by employing force, intimidation or
deception against any person.

COUNT TWO:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, MAITHEW J. MIKA, of the crime of CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE IN THE SEVENTH DEGREE, a class A misdemeanor, contrary to Penal Law Section 220.03, committed on or about October 23, 2023, in the City of Batavia, in the County of Genesee:
At said time and place, MATTHEW J. MIKA, knowingly and unlawfully possessed a controlled substance, to wit: Cocaine.

MOSS, of the crime of CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE IN THE THIRD DEGREE, a class B felony, contrary to Penal Law Section 220.16(1), committed on or about December 4, 2023, in the Town of Batavia, in the County of Genesee:
At said time and place, STACY R. MOSS, knowingly and unlawfully possessed a narcotic drug, to wit: Fentanyl, with intent to sell it.

COUNT THREE:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, STACY R. MOSS, of the crime of CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE IN THE FIFTH DEGREE, a class D felony, contrary to Penal Law Section 220.06(1), committed on or about December 4, 2023, in the Town of Batavia, in the County of Genesee:
At said time and place, STACY R. MOSS, knowingly and unlawfully possessed a controlled substance, to wit: Vyvanse, with intent to sell it.

At said time and place, ADRIAN L. SHEPPARD, with intent to defraud, deceive or injure another, uttered or possessed a forged instrument as specified in section 170. 10, to wit: a New York State vehicle inspection sticker

The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, ADRIAN L. SHEPPARD, of the crime of CRIMINAL POSSESSION OF STOLEN PROPERTY IN THE FOURTH
DEGREE, a class E felony, contrary to Penal Law section
165.45 committed on or about October 6, 2023, in the City of Batavia, in the County of Genesee:
At said time and place, ADRIAN L. SHEPPARD, knowingly possessed stolen property, with intent to benefit himself or a person other than an owner thereof or to impede the recovery thereof by the owner; the value of said property exceeding one thousand dollars.

City of Batavia, in the County of Genesee:
At said time and place, KOREE R. STEPHENSON, knowingly and unlawfully introduced dangerous contraband, consisting of Cocaine and a glass pipe, into the detention facility known as the Genesee County Jail
COUNT TWO:
The Grand jury of Genesee County, by this count in this Indictment, accuses the defendant, KOREE R. STEPHENSON, of the crime of PROMOTING PRISON CONTRABAND IN THE SECOND DEGREE, a class A misdemeanor, contrary to Penal Law Section 205.20(2), committed on or about August 27,
2023, in the City of Batavia, in the County of Genesee.

At said time and place, KOREE R. STEPHENSON, knowingly and unlawfully introduced contraband, consisting of Cocaine and a glass pipe, into a detention facility called the Genesee County Jail.

COUNT THREE:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, KOREE R. STEPHENSON, of the crime of CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE IN THE SEVENTH DEGREE, a class A misdemeanor, contrary to Penal Law Section 220.03, committed on or about August 27, 2023, in the City of Batavia, in the County of Genesee:
At said time and place, KOREE R. STEPHENSON, knowingly and unlawfully possessed a controlled substance, to wit: Cocaine.

At said time and place, DYLAN T. JORDAN, with intent to prevent Batavia Police Department Officer —— —-, from performing a lawful duty, attempted to cause physical injury to said officer by using his arms to apply pressure to the neck of Officer —- ——.

The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, DYLAN T. JORDAN, of the crime of ATTEMPTED STRANGULATION IN THE SECOND DEGREE, a class E
felony, contrary to Penal Law Sections 110.00 and 121.12, committed on or about January 15, 2024, in the City of Batavia,
in the County of Genesee:
At said time and place, DYLAN T. JORDAN, with the intent to impede the normal breathing or circulation of the blood, applied pressure on the throat or neck of Officer —- — in an
attempt to cause stupor, loss of consciousness for any period of time, or any other physical injury or impairment.

COUNT THREE:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, DYLAN T. JORDAN, of the crime of CRIMINAL OBSTRUCTION OF BREATHING OR BLOOD CIRCULATION, a
class A misdemeanor, contrary to Penal Law Section 121. 11 committed on or about January 15, 2024, in the City of Batavia, in the County of Genesee:
At said time and place, DYLAN T. JORDAN, with the intent to impede the normal breathing or circulation of the blood, applied pressure on the throat or neck of Officer —- —–.

COUNT FOUR:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, DYLAN T. JORDAN, of the crime of OBSTRUCTING GOVERNMENTAL ADMINISTRATION IN THE SECOND DEGREE,
a class A misdemeanor contrary to Penal Law Section 195 05, committed on or about January 15, 2024, in the City of Batavia, in the County of Genesee:
At said time and place, DYLAN T. JORDAN, intentionally obstructed, impaired or perverted the administration of law or other governmental function or prevented or attempted to prevent
a public servant from performing an official function by means of intimidation, physical force or interference or by means of any independently unlawful act.

COUNT FIVE:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, DYLAN T. JORDAN, of the offense of HARASSMENT IN THE SECOND DEGREE, a violation, contrary
to penal Law Section 240.26 (1), committed on or about January 15, 2024, in the City of Batavia, in the County of Genesee:
At said time and place, DYLAN T. JORDAN, with intent to harass, annoy or alarm C.G., forcibly shoved C.G. with two hands, causing C.G. to lose balance.

JOY, of the crime of DRIVING WHILE INTOXICATED, AS A CLASS E FELONY, contrary to Vehicle and Traffic Law Sections 1192 (3) and 1193—1 (c) (i), committed on or about October 16, 2023, in the Town of Pavilion,
in the County of Genesee:
At said time and place, under circumstances set forth in the special information, JESSIE B. JOY operated a motor vehicle on a public highway, while in an intoxicated condition.

Special Information

KEVIN T. FINNELL, District Attorney of Genesee County, states that the defendant, JESSIE B. JOY, was previously convicted of Driving While Intoxicated, an unclassified misdemeanor, in violation of Section 1192—3 of the New York State Vehicle and Traffic Law, on or about June 7, 2016, in Pavilion
Town Court, County of Genesee, State of New York.

The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, WILLIAM J. VEGA-RODRIGUEZ, of the crime of OFFERING A FALSE INSTRUMENT FOR FILING IN THE FIRST DEGREE, a class E felony, contrary to Penal Law Section 175.35 (1), committed on or about August 24, 2023, in the City of Batavia, in the County of Genesee:
At said time and place, WILLIAM J. VEGA-RODRIGUEZ, knowing that a written instrument, to wit: a New York State Pistol permit application, contained a false statement or false information,
and with intent to defraud the state of any political subdivision, public authority or public benefit corporation of the state, he offered or presented it to a public office, public servant, public authority or public benefit corporation with the knowledge or belief that it would be filed with, registered or
recorded in or otherwise become a part of the records of such public office, public servant, public authority or public benefit corporation.

The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, DUSTIN A. HUFFER of the crime of DRIVING WHILE INTOXICATED, AS A CLASS E FELONY, contrary to
Vehicle and Traffic Law Sections 1192 (3) and 1193—1 (c) (i), committed on or about November 19, 2023, in the Town of Pembroke, in the County of Genesee:
At said time and place, under circumstances set forth in the special information, DUSTIN A. HUFFER operated a motor vehicle on a public highway, while in an intoxicated condition.

COUNT TWO:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, DUSTIN A. HUFFER, of the crime of DRIVING WHILE INTOXICATED, PER SE, AS A CLASS E FELONY, contrary to Vehicle and Traffic Law Sections 1192 (2) and 1193-1 (c) (i), committed on or about November 19, 2023, in the Town of Pembroke, in the County of Genesee:

At said time and place, DUSTIN A. HUFFER, operated a motor vehicle on a public highway, while having a blood alcohol content of .08 of one per centum or more.

At said time and place, under circumstances set forth in the special information, NATHANIEL BEGLINGER, knowingly and unlawfully possessed a stimulant, to wit: Methamphetamine, with intent to sell it.

COUNT TWO:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, NATHANIEL BEGLINGER, of the crime of CRIMINAL SALE OF A CONTROLLED SUBSTANCE IN THE THIRD DEGREE, a class B felony, contrary to Penal Law section 220.39(2), committed on or about January II, 2024, in the Town of Alexander, in the County of Genesee:
At said time and place, under circumstances set forth in the special information, NATHANIEL BEGLINGER, knowingly and unlawfully sold a stimulant, to wit: Methamphetamine.

COUNT THREE:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, NATHANIEL BEGLINGER, of the crime of CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE IN THE THIRD DEGREE, a class B felony, contrary to Penal Law Section 220.16(2), committed on or about February 13, 2024, in the Town of Alexander, in the County of Genesee:
At said time and place, under circumstances set forth in the special information, NATHANIEL BEGLINGER, knowingly and unlawfully possessed a stimulant, to wit: Methamphetamine, with intent to sell it.

COUNT FOUR:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, NATHANIEL BEGLINGER, of the crime of CRIMINAL SALE OF A CONTROLLED SUBSTANCE IN THE THIRD DEGREE, a class B felony, contrary to Penal Law section 220.39(2), committed on or about February 13, 2024, in the Town of Alexander, in the County of Genesee:
At said time and place, under circumstances set forth in the special information, NATHANIEL BEGLINGER, knowingly and unlawfully sold a stimulant, to wit: Methamphetamine.

HARTMAN, of the crime of ASSAULT IN THE SECOND DEGREE, a class D violent felony, contrary to Penal Law Section 120.05 (2) t committed on or about December 16, 2023, in the Town of Alabama, in the County of Genesee:
At said time and place, PEYTON B. HARTMAN, with intent to cause physical injury to another person, he caused physical injury to such person by means of a dangerous instrument.

COUNT TWO:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, PEYTON B. HARTMAN, of the crime of RECKLESS DRIVING, an unclassified misdemeanor, contrary
to Vehicle and Traffic Law Section 1212, committed on or about December 16, 2023, in the Town of Alabama, in the County of Genesee :

At said time and place, PEYTON B. HARTMAN, did operate a motor vehicle, on Kenyon Avenue, in a manner which unreasonably interfered with the free and proper use of a public highway,
road, street or avenue or unreasonably endangered users of a public highway.

COUNT THREE:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, PEYTON B. HARTMAN, of the crime of RECKLESS ENDANGERMENT IN THE SECOND DEGREE, a class A
misdemeanor, contrary to Penal Law section 120.20, committed on or about December 16, 2023, in the Town of Alabama, in the County of Genesee:
At said time and place, PEYTON B. HARTMAN, recklessly engaged in conduct which created a substantial risk of serious physical injury to another person.

COUNT FOUR:
The Grand Jury of Genesee County, by this count in this Indictment, accuses the defendant, PEYTON B. HARTMAN, of the crime of RECKLESS ENDANGERMENT IN THE FIRST DEGREE, a class D
felony, contrary to Penal Law section 120.25, committed on or about December 16, 2023, in the Town of Alabama, in the County of Genesee:
At said time and place, PEYTON B. HARTMAN, under circumstances evincing a depraved indifference to human life, recklessly engaged in conduct which created a grave risk of death to another person.

HARTMAN, of the crime of ASSAULT IN THE SECOND DEGREE, a class D violent felony, contrary to Penal Law Section 120.05 committed on or about December 16, 2023, in the Town of Alabama, in the County of

At said time and place, PEYTON B. HARTMAN, recklessly caused serious physical injury to another person by means of a dangerous instrument.
