WYOMING COUNTY SHERIFF’S REPORT/Warsaw man charged after ATV accident in Gainesville

Deputies responded to the area of Dutton Road in the Town of Gainesville for a report of an
ATV accident with injury on July 1, 2024.

Upon arrival, deputies located a male approximately twenty feet down a ravine. The male was injured with a possible broken leg. The Wyoming County Rope Rescue Team responded and extricated the male from the ravine, bringing him back up to the roadway. The male was identified as Emmanuel E. Martina, 22, of Warsaw.

Deputies observed Martina to allegedly have general indicators of intoxication while speaking with him. Further investigation found that Martina was allegedly intoxicated while operating the ATV northbound on Dutton Road before crashing into the guardrail on the eastside of the roadway.

Martina was arrested and charged with DWI, along with other vehicle and traffic violations. A chemical
sample was secured from Martina while in the back of the ambulance before being air-lifted to
Strong Memorial Hospital for his injuries.

Martina is due back in the Town of Gainesville Court on 07/22/24 at 6:00 p.m.

On July 3, 2024, at approximately 4:02 P.M., a Wyoming County Sheriff’s deputy performed a vehicle
stop for speed in zone. The deputy recognized alleged signs of impairment from drugs while speaking with the operator of the vehicle, Stephen Thompson, 47, of Attica, NY, who had a revoked NYS
driver’s license for a Driving While Ability Impaired by Drugs conviction.

Thompson was asked to perform Standardized Field Sobriety Testing which he performed poorly on. Thompson submitted to a Drug Recognition Expert evaluation, in the Drug Recognition Expert’s opinion Thompson was allegedly impaired by drugs and it was unsafe to operate a motor vehicle.

Thompson was arrested and charged with Driving While Ability Impaired by Drugs- Previous
Offense, Driving While Ability Impaired by Drugs-Combination with, Aggravated Unlicensed Operation First Degree, and other vehicle and traffic law infractions.

Thompson was arraigned at Warsaw Village Court and was remanded to the Wyoming County Jail on no bail due to previous felony convictions. Thompson’s next appearance is at Warsaw Village Court on July 22, 2024.

John Smithers, 62, of Buffalo, NY, was arrested by the Wyoming County Sheriff’s Office on a
previously issued warrant. Smithers had been picked up by Lackawanna Police on other
charges and then turned over to the Wyoming County Sheriff’s Office after issuing him
appearance tickets on their charges.

Smithers, who was previously arrested by the Wyoming County Sheriff’s Office for Theft of Service and Criminal Tampering, had been arraigned and released numerous times since the initial arrest, but would never appear to the next appointed court date.

Smithers was charged by the Wyoming County Sheriff’s Office with Bail Jumping. He was arraigned in Wyoming County Supreme Court and held at the Wyoming County Jail on both charges.

On June 21, 2024, Wyoming County deputies responded to the intersection of Rt. 77 and
Rt. 354 in the Town of Bennington, for a motorcycle/truck accident. After an investigation,
deputies say the pickup truck involved had a suspended NYS Registration due to
insurance lapse.

The owner-operator, Jeanne Darsow, 53, of Lockport, NY, was arrested for operating
with suspended registration and released with an appearance ticket. Darsow is to appear in the
Bennington Town Court at a later date.

On June 27, 2024, at approximately 7:59 P.M., a deputy from the Wyoming County Sheriff’s Office
performed a traffic stop after a speeding violation. The deputy recognized alleged signs of impairment from alcohol while speaking with the operator of the vehicle, Aaron Youngman, 34, of Penfield, NY.

Youngman was asked to perform Standardized Field Sobriety Testing which he performed poorly on.
Youngman refused to take a chemical test to determine his blood alcohol content.

Youngman was arrested and charged with Driving While Intoxicated along with other vehicle and traffic law infractions. Youngman was arraigned at Attica Village Court, where his license was suspended for refusal to submit to a chemical test. Youngman was released on his own recognizance and is to appear in Attica Village Court on August 5, 2024.

On June 25, 2024, at around 12:50 A.M, a deputy with the Wyoming County Sheriff’s Office was
operating stationary patrol on West Buffalo Street in the Village of Warsaw, when a vehicle was
observed traveling westbound with a suspended registration.

A vehicle and traffic enforcement stop was conducted near North Maple Street and the driver was identified as Mazed A. Oney, 34, of Depew, NY.

Following an on-scene investigation, Oney was arrested and charged with Operating a Motor Vehicle with a suspended registration. Oney was processed roadside and released on an appearance ticket and is scheduled to appear in the Warsaw Village Court at a later date

Harley M. Felerski, 22, of Warsaw, NY, was arrested and charged with Petit Larceny following a shoplifting
complaint at Walmart in the Town of Warsaw on June 24, 2024.

It was reported that Felerski had allegedly concealed approximately $203.18 of various make-up merchandise on her person without paying.

Felerski was charged with Petit Larceny and issued an appearance ticket and is due back in the
Town of Warsaw Court at a later date.
