GENESEE COUNTY/The Office of Cannabis Management Enforcement Division marks three stores in Batavia, removing items which require licensing

The Office of Cannabis Management/Enforcement Division made a few stops through Batavia today, 7.11.24, posting signs and Notices of Violation for alleged illegal cannabis that was seized at three stores in the noon hour.

According to a witness, about 10-12 state officers converged upon D-R Smoke Shop at 8351 Lewiston Road about 1:30p.m. Officers left the store with two large bags and placed the above warning on the store’s front door along with a Notice of Violation/order to cease unlicensed activity.

In the Notice of Violation, allegedly observed inside the store were products which require licensing, cannabis edibles, cannabis concentrates and cannabis flowers along with a point-of-sale system, packaging and an ATM. Also, a price list for cannabis, cannabinoid and hemp products. The store was ordered to cease unlicensed activity.

Front door at Batavia Smoke Shop at 515 East Main Street

At the other end of town, the Batavia Smoke Shop at 515 East Main Street was also served a Notice of Violation. According to a sales representative, items in a glass case were removed from the store and notices posted on their front door as well.

The Notice of Violation says that cannabis flowers, cannabis edibles and cannabis concentrates were allegedly observed in the store with a point-of-sale system, an ATM, scale and packaging.

The store was ordered to cease unlicensed activity.

Front door at Herb City at 565 E. Main Street

Down the street from Batavia Smoke Shop, Herb City at 565 E. Main Street was also allegedly offering products that require licensing, cannabinoid hemp flowers, edibles, concentrates for sale, THC-O. THC-P, THC-X and HHC products were noted. Also allegedly observed, equipment or tools indicating the location was operating as a cannabis retailer, cultivator or processer with a point-of-sale system, laptop with inventory, pricing and a security camera.

Herb City was ordered to cease unlicensed activity.

The penalty for selling cannabis without a license in NYS is $10,000 per day for engaging in unlicensed sales and $20,000 per day if you continue to sell cannabis after receiving a Notice of Violation, also building owners can be fined $10,000 a day for allowing unlicensed cannabis sales on their property.

  1. So dumb. The rez has hundreds of shops with no regulation lol.

    • That’s because they are sovereign, state doesn’t control them, it would have to be a federal issue or else they are left to their own policing and laws
