On 7/15/2024, at about 8:00p.m., members of the Batavia Police Department NET Unit conducted a traffic stop on Ellicott Street for a traffic infraction. After a roadside investigation and K9 deployment, officers searched the vehicle. Inside the vehicle, officers located a large quantity of narcotics as well as a loaded handgun. The gun had previously been reported stolen from Erie County.
The three occupants O’darius A. Hamilton (left), Taheed M. Moffett(top) and Carlos D. Hightower (bottom) were each charged with Criminal Possession of a Weapon 2nd degree and Criminal Possession of Stolen Property 4th degree.
Moffett and Hamilton were additionally charged with Criminal Possession of a Controlled Substance 3rd degree (Intent to Sell). Hamilton was also charged with Criminal Possession of a Controlled Substance 4th degree and two counts of Criminal Use of Drug Paraphernalia 2nd degree.
All three were arraigned in Batavia City Court on 7/16/2024 and are due back in court at a later date.

On 7/21/2024, Batavia Police Officers conducted a traffic stop on Raymond Ave. After an investigation and subsequent vehicle search, officers located a large quantity of narcotics. The occupants of the car, Richard C. Dumbleton (above) and Robert J. Karker, were arrested and each was charged with two counts of Criminal Possession of a Controlled Substance 3rd degree.
Dumbleton was additionally charged with Criminal Possession of a Weapon 3rd degree, two counts of Criminal Use of Drug Paraphernalia and a traffic violation. He was arraigned in CAP Court. Karker was arraigned and held as a fugitive from justice on a warrant out of Kentucky. He was remanded to the Genesee County Jail to await extradition.

On 7/23/2024, Daniel J. Bakowski, 43, of West Valley, NY, was arrested on a warrant for Criminal Possession of a Controlled Substance 5th degree. The warrant stems from an incident on 12/2/2023, when Bakowski was allegedly found in possession of narcotics. He was arraigned in CAP Court and is due in Batavia City Court at a later date. ____________________________________________________________________________________________________________
On 7/14/2024, Kamau S. Freeman, 30, of Buffalo, NY was arrested and charged with Robbery 3rd degree, Criminal Contempt 1st degree, Criminal Mischief 3rd degree and Grand Larceny 4th degree. Freeman was arrested following an investigation into a domestic incident where he allegedly forcibly stole property and damaged it. He was arraigned in CAP Court and is due in Batavia City Court at a later date. ____________________________________________________________________________________________________________
On 7/16/2024, Timothy W. Szurgot, 39, was arrested and charged with Grand Larceny 4th degree. The arrest is the result of an investigation into a motor vehicle theft. It’s alleged that Szurgot stole a vehicle, from the parking lot of Quicklees, on 9/30/2022. He was arraigned in Batavia City Court and is scheduled to re-appear on 8/15/2024.

On 7/15/2024, Bryant W Herdtner (age 36) of Batavia, was arrested for Criminal Possession of a Weapon 3rd and Menacing 2nd. It’s alleged that Herdtner threatened another person, with a sledgehammer, during an altercation on Tracy Avenue. He was arraigned in CAP Court and is due in Batavia City Court at a later date.

On 7/22/2024, Brant G. Matthews, 29, of Batavia, NY was arrested and charged with Resisting Arrest and Obstructing Governmental Administration 2nd degree. It’s alleged that Matthews fled from police on foot when they attempted to arrest him on outstanding charges. He was issued an appearance ticket and is due in Batavia City Court on 8/13/2024.

On 7/18/2024, Mitchell D. Merrill, 38, of Batavia, NY was arrested and charged with Criminal Possession of a Controlled Substance 7th degree. Merrill was allegedly found in possession of crack cocaine when police arrested him on unrelated charges. He was issued an appearance ticket and is due in Batavia City Court on 8/6/2024.

On 7/20/2024, Brant G. Matthews, 29, of Batavia, NY, was arrested and charged with Petit Larceny. Matthews allegedly stole a bicycle from a residence on East Avenue, he was issued an appearance ticket and is due in Batavia City Court on 8/6/2024.

On 7/17/2024, Gregory D. Nevinger, 38, of Batavia, NY, was arrested and charged with Harassment 2nd degree. Nevinger was charged after allegedly threatening another person during an altercation on Bank Street. He was arraigned in Batavia City Court and released. He is due back in court on 8/1/2024.

On 7/17/2024, Haley M. Stempniak, 22, of Batavia, NY, was arrested and charged with DWI. Stempniak was arrested after police responded to the report of a property damage motor vehicle accident on East Main Street.

On 7/20/2024, Ryan T. Ziegler, 33, of Attica, NY, was arrested and charged with DWI. Ziegler was arrested after police responded to the report of a property damage motor vehicle accident on West Main Street.
Ziegler was issued appearance tickets and is due in court on 7/30/2024.

On 7/21/2024, Gary L. Naylor, 30, of Batavia, NY, was arrested and charged with DWI. Naylor was arrested following a traffic stop on Washington Avenue, where he was allegedly found to be driving while intoxicated by alcohol. Naylor was issued several traffic tickets and is due in court on 8/7/2024.

On 7/27/2024, Nicholas C. Kingdollar, 28, of Batavia, NY, was arrested and charged with Criminal Contempt 1st degree and Assault 3rd degree. It’s alleged that Kingdollar engaged in a physical altercation with the protected party of an Order of Protection, causing injury.
He was arraigned in CAP Court and is due in Batavia City Court at a later date.

On 7/23/2024, Terry N. Holloway, 41, of Batavia, was arrested and charged with Grand Larceny 4th degree, Criminal Possession of Stolen Property 4th degree, and Criminal Mischief 4th degree. It’s alleged that Holloway stole a motorcycle from a residence on Wood Street. He was arraigned in Batavia City Court and remanded to the Genesee County Jail. He is due back in court, on 8/6/2024.

On 7/24/2024, Louis S. Szabo, 24, and Hillary D. Russell, 31, of both of Batavia, NY, were each arrested and charged with trespass.
Szabo and Russell allegedly trespassed on a property on Evans Street. Szabo was also charged with Criminal Mischief 4th degree for allegedly damaging property.
He was issued an appearance ticket and is due in court, on 8/6/2024.

On 7/29/2024, Justin T. Gladney, 35, of Batavia, NY was arrested and charged with Criminal Contempt 2nd degree. Gladney allegedly contacted the protected party of a stay-away order of protection over social media. He was issued an appearance ticket and is due in Batavia City Court, on 8/13/2024.

On 7/23/2024, Daniel J. Bakowski, 43, of West Valley, NY, was arrested and charged with Obstructing Governmental Administration 2nd degree and Failure to Stop at a Stop Sign.
Bakowski was arrested after a police officer with the City of Batavia NET Unit attempted to arrest Bakowski on several outstanding warrants. Bakowski allegedly fled from police on an e-bike, before being stopped and taken into custody. He was issued an appearance ticket and is being held at the Genesee County Jail for arraignment on his warrants.

On 7/25, 2024, Edward D. Grant III, 28, of Rochester, NY, was arrested and charged with Unlawful Fleeing 3rd degree and numerous vehicle and traffic violations. It’s alleged that Grant fled from Batavia Police and Genesee County Sheriff’s Deputies in a vehicle. The pursuit passed through the City of Batavia, before ending on the Thruway.
Grant was issued several tickets and is due in court on 8/6/2024.

Navaeh C. Welch, 19, of Batavia, NY, and a 16-year-old female, were arrested and charged with Disorderly Conduct, after an investigation into a fight that occurred on 7/20/2024 at Austin Park.
It’s alleged that both Welch and the juvenile engaged in a fight with multiple people at the park. The 16-year-old was additionally charged with Harassment 2nd degree for allegedly striking a Genesee County Sheriff’s Deputy in the face.
Both were issued appearance tickets and are due in Batavia City Court on 7/30/2024.

On 7/25/2024, Ashley T. Bowman, 19 of Batavia, NY, was arrested on an arrest warrant for Trespass and Criminal Mischief 4th degree. It’s alleged that on 5/27/2024, Bowman entered onto a property on Dewey Ave and threw a rock at a window. She was arraigned in Batavia City Court and released. She is due back in court, on 8/15/2024.
