New Town of Batavia Courts Facility location at 4120 West Main Street Road
The Town of Batavia is moving forward and is in the planning stages of creating a new Courts Facility on West Main Street Road. According to Town Board member Patti Michalak, who is on the Interior Design Committee, they are moving forward with the interior floor plan and finalizing the court clerk’s offices, judge’s chambers, the courtroom and jury box along with adding on to the back of the building to create a secure entryway for law enforcement and persons who are in custody.
“Because we are doing a lot more jury trials then we ever did before, by NYS law you have to have certain parameters you have to meet,” says Michalak. “We walked through, and it does need some updating and some changes.”
“We didn’t really have a jury box; these are things they want you to have. We are going to have a larger bench, a witness stand and a jury box for up to 8 people”
Michalak says the ramp on the side entrance to the building will be the main entrance and the back will have a secure entrance added. There will also be a deliberation room, security area and a secure clerk payment area.
The Batavia Town Board voted in their March 20, 2024 meeting to use American Rescue Plan Act (ARPA)
Funds (Coronavirus State and Local Fiscal Recovery Funds) from the U.S. Department of Treasury in a
total amount of $704,510.70 for the purpose of a court facility project and to relocate
the court facility to 4120 West Main Street Road, the former Tomaszewski Funeral Home.

The Town closed on the commercial property with ACME Holdings of WNY INC on March 13, 2024. The property is .72 acres and is 9,000 square feet.
The purchase was not subject to permissive referendum pursuant to Town Law as the expenditure was financed with surplus funds according to the July 19, 2023 resolution.
Michalak hopes that after working with their consultant and putting the project out to bid, the new Town of Batavia Courts Facility will be open by next year at this time.
