GENESEE COUNTY SHERIFF’S REPORT/August 30,2024

Brett N. Magoffin, 49, of Pavilion, NY, is charged with endangering the welfare of a child and criminal obstruction of breathing of a child, after an incident in Pavilion on August 22, 2024 at 8:18p.m.

Magoffin was issued an appearance ticket and will appear in the Town of Pavilion Court on September 16, 2024, at 1:30p.m.

Cain A. Catino, 53, of Batavia, NY, is charged with burglary 3rd degree and petit larceny after allegedly entering Walmart, at 4133 Veteran’s Memorial Drive in Batavia, and allegedly unlawfully stole merchandise valued at $269.74 on August 19, 2024.

Catino is also charged with falsifying business records 1st degree after allegedly signing a Pawn King bill of sale under penalty of perjury that he was the sole owner of merchandise that had been stolen.

Catino was held at the jail pending a CAP Court arraignment on August 21, 2024 at 9:00p.m.

Willie A. Sabb Jr., 50 of Batavia, NY, and Ashley J. Gallagher, 35, homeless, of Rochester, NY, are each charged with criminal possession of a controlled substance 7th degree after a traffic stop at the 490 Truck Stop on S. Lake Road in the Town of Le Roy on August 24, 2024 at 4:54p.m.

Sabb Jr. and Gallagher were allegedly in possession of a quantity of crack cocaine and drug paraphernalia.

Sabb Jr. was also charged with false personation, aggravated unlicensed operation 3rd degree, failure to stop at a stop sign and speeding in a zone. He also had an active arrest warrant out of Genesee County Family Court.

Gallagher was additionally charged with tampering with physical evidence and allegedly had drug contraband on her person. Gallagher also had an active arrest warrant out of the Gates Police Department.

Both will appear in the Town of Le Roy Court on September 10, 2024 at 1:00p.m.
