GENESEE COUNTY/Judge declines to suppress statements after Huntley Hearings for Elmore and Wilcox

Michael J. Elmore and Lyndsey J. Wilcox along with their attorneys appeared in Genesee County Court on Friday morning for a discovery conference in front of Judge Donald O’Geen.

Judge O’Geen declined to suppress any of the statements made by the defendants and did not grant the motions made by the defendant’s attorneys in last month’s Huntley hearings.

Also addressed during the court appearances were 5 or 6 discovery documents that were not received by defense attorneys until after the pair’s August court appearance.

“The documents we are talking about are one document that was created nine days before it was tuned over. Then there was another document that had no substantive changes, but simply a signature on a form that already had been electronically signed. Some of the documents were administrative from the Jail,” said District Attorney Kevin Finnell.

Attorneys for both Wilcox and Elmore say they will review the 5-6 discovery documents. Judge O’Geen advised that motions must be filed by October 1, 2024. Wilcox and Elmore will reappear in Genesee County Court on October 16th, 2024, which is the plea cutoff date.
