When Officers arrived, Swede was located in a vehicle in the driveway of the same address and was arrested and charged with Criminal Contempt second degree, a class A misdemeanor in the State of New York, which is a qualified offense for violating an order of protection.

Subsequently, because the current charge of Criminal Contempt second degree is within five years of a
previous conviction of the same charge from the City of Batavia, Swede was additionally charged with an
Aggravated Family Offense, a class E felony in the State of New York, which is a qualified offense with no bail.

Swede was arraigned in the Village of Perry Court before the Honorable Judge Wolcott and remanded to the Wyoming Couty Jail with no bail until his next court date.
