Michael J. Elmore, 33, and Lyndsey J. Wilcox, 39, both of Batavia, appeared in Genesee County Court on Monday morning, accepting plea deals in the death of Sgt. Thomas Sanfratello on March 10, 2024 at Batavia Downs.

Elmore pleaded guilty to the top count in the indictment, Aggravated Manslaughter 1st degree/intent to cause injury, a class B violent felony and obstructing governmental administration 2nd degree. He will face a determinate sentence of no more than 20 years and 5 years probation when he is sentenced in on December 17th, at 9:30am. Elmore admitted to being a second felony offender, being convicted of Attempted Burglary 2nd degree on June 17, 2016.
Elmore was remanded to the jail without bail.
Wilcox pleaded guilty to Assault 2nd degree, a class D violent felony and was released under the supervision of Genesee Justice on time served, she was sentenced to 6 months shock probation and will face 5 years probation when sentenced on January 21, 2025.
