WYOMING COUNTY SHERIFF’S REPORT/November 19, 2024

On November 5th, 2024, the Wyoming County Sheriff’s Office was contacted by a hunter in
regards to concerning activity captured on his trail camera located on a property on Stinson Road
in the Town of Java.

The trail camera footage captured a possible assault of a female.

After an investigation, the victim was found with the suspect who was identified as Matthew
Murcin. Murcin was charged with Assault 2nd degree, Strangulation 2nd degree, Unlawful
Imprisonment 2nd degree and Aggravated Family Offense.

Murcin was arraigned at the Town of Wethersfield Court and held. He was transported to the Wyoming
County Jail. Murcin is to appear in the Town of Java Court on November 20th, 2024.

Following a husband/wife domestic incident at on Telegraph Road in the Town of Pike, both
Sigfrido Bautista-Bautista, 30 of Pike and Octavio Hernandez, 28, of Pike were arrested.

Further investigation showed that Bautista-Bautista and Hernandez got into physical fight while
at the residence while in the presence of a two-year-old child, resulting in Hernandez breaking a
glass pane on the front door.

Bautista-Bautista also allegedly punched Hernandez in the face multiple times, causing Hernandez to have a fat lip and facial lacerations. Hernandez refused any EMS on scene and denied being injured. As a result, Bautista-Bautista was arrested and charged with endangering the welfare of a child and attempted assault in the third degree.

Subsequently, Hernandez was also charged with endangering the welfare of a child and criminal mischief in the 4th degree. Hernandez was issued an appearance ticket for his charges, and is due back in the Town of Pike Court at a later date.

Bautista-Bautista was arraigned in the Town of Wethersfield Court and released on his own recognizance, and is due back in the Town of Pike Court at a later date.

A full stay away order of protection was issued by Judge Errington against Bautista-Bautista.

Eric E. Heizmann, 46, of Auburn, NY, was arrested and charged with Criminal Contempt in the 1st
degree after violating a full stay-away order of protection while incarcerated at the Wyoming
County Jail on 11.12.24.

Further investigation showed that Heizmann allegedly violated the full stay-away order of protection after he had made contact with the protected party via phone requesting them to bail
him out of jail.

Heizmann was currently incarcerated for Criminal Contempt in the 1st degree
and had a Criminal Contempt conviction within the preceding five years. Due to committing a
family offense to a victim while having a family offense related conviction in the preceding five
years, Heizmann was subsequently charged with Aggravated Family Offense, a class E felony.

Heizmann was arraigned in the Town of Warsaw Court and remanded back to the Wyoming
County Jail in lieu of $25,000 cash bail/ $50,000 bond. Heizmann is due back in the Village of
Warsaw Court on 11/18/24.

Eric E. Heizmann, 46, of Auburn NY, was arrested and charged with Criminal Contempt in the
second degree after violating a mandated order of protection while at a residence in the Town of
Castile on 11.12.24.

Further investigation showed that Heizmann had a previous conviction of Criminal
Contempt in the second degree in 2021, resulting in Heizmann being subsequently charged with
Criminal Contempt in the first degree and Aggravated Family Offense, both class E felonies in
the New York State Penal Law.

Heizmann was arraigned at the Village of Warsaw Court and remanded to the Wyoming County Jail in lieu of $2,500 bail/ $5,000 bond. Heizmann is due back in the Town of Castile Court on 11/18/2024.

A man was charged following the investigation of a false written business agreement.

Shawn R. Merwin, 43, of Canandaigua, N.Y. was charged with Forgery in the Third Degree following
the investigation. Merwin was arraigned in the Perry Village Court before Justice Wolcott and
was released on his own recognizance.

Merwin is scheduled to appear in the Village of Perry Court at a later date.
