GENESEE COUNTY/Wilcox sentenced to 5 years probation and 6 months in jail which she has already served

Lyndsey J. Wilcox was sentenced in Genesee County Court on Tuesday morning in the assault of Sgt. Thomas Sanfratello on March 10, 2024 at Batavia Downs. Wilcox pleaded guilty to Assault 2nd degree, a class D violent felony in a November 18th, 2024 plea deal and was released under the supervision of Genesee Justice on time served

Today, Judge Lightcap Cianfrini sentenced Wilcox to 6 months of incarceration, which she has already completed, serving 252 days in jail before accepting the plea deal in November. Wilcox was also sentenced to 5 years of Probation and has to pay a $2,500 fine. Several orders of protection were also issued.

Before sentencing, two members of Sgt. Thomas Sanfratello’s family spoke to the court. His 21-year-old daughter and his son. Both shared how they are missing their father and how he will not be here for them during their milestones in life.

Wilcox declined to speak to the court before sentencing.

Judge Lightcap Cianfrini told the defendant that she was the reason why the incident happened.

In the Pre-sentence Investigation report, the Judge said Wilcox wrote that she was remorseful. Wilcox also wrote that she was a good person and a well-respected person in the community. The Judge told Wilcox she was delusional.

“The reason you’re not a good member of society is because of all this.”

The Judge then asked if a good member of society goes out and drinks a large amount of alcohol and then goes to the casino, calling police b_tches and the N word.

“You are going to be forever tied to this. But this family is giving you a chance by agreeing to this plea offer. You should take this chance and run with it, you should rededicate your life and do good instead of drinking, using racist language and insulting people,” said Judge Lightcap Cianfrini.

On December 17th, 2024, Michael Elmore was sentenced to 20 years in prison and 5 years of post-release supervision after pleading guilty to Aggravated Manslaughter 1st degree, a class B felony, and obstructing Governmental Administration 2nd degree, a class A misdemeanor on November 18th.
