Timothy M. Brady, 57, of Jerico Rd., Bergen, is charged with aggravated unlicensed operation of a motor vehicle 1st, DWI, refusal to take a breath test, leaving the scene of a property damage accident and driving through\/around\/under a railroad barrier, after deputies responded to the area of 7711 Townline road in Bergen on August 28, 2020 at 11:11p.m., for a report of a motor vehicle that had collided with a train.<\/p>\n\n\n\n

When deputies arrived on scene, they found a motor vehicle completely engulfed in flames and the operator fled the scene on foot.<\/p>\n\n\n\n

Brady was found a short time later not far from the scene.<\/p>\n\n\n\n

He was released with appearance tickets and is due back in Bergen Town Court on October 8, 2020 at 5:00p.m.<\/p>\n\n\n\n

On August 12, 2020, the Batavia Emergency Response Team executed a search warrant at 22 Hutchins Place after a narcotics investigation by the Genesee County Local Drug Task Force. <\/p>\n\n\n\n

As a result of the investigation, Desiree Hutchinson, 25, of Liberty St., Batavia is charged with two counts of criminal possession of a controlled substance 3rd, a class B felony, criminal possession of a controlled substance 4th, a class C felony, criminal use of drug paraphernalia 2nd, a class A misdemeanor, and unlawful possession of marijuana, a violation.<\/p>\n\n\n\n

On August 28, 2020, Hutchinson was located by Det. Sgt. Lutey of the Batavia Police Department and arrested.<\/p>\n\n\n\n

Hutchinson will be arraigned in front of Judge Rogers.<\/p>\n\n\n\n

The City of Batavia Police Department, Genesee County Sheriff’s Office and the Genesee County District Attorney’s Office also assisted in the investigation.<\/p>\n\n\n\n

David Rivera, 30, of Buckus St., Rochester, NY, is charged with DWI and aggravated DWI, after allegedly operating a vehicle in an intoxicated condition on N. Lake avenue in Bergen on August 29, 2020 at 5:56a.m.<\/p>\n\n\n\n

Rivera was released on appearance tickets and will appear in Bergen Town Court on October 7, 2020 at 5:00p.m.<\/p>\n\n\n\n
