Joshua D. Huntress, 29, of Mayville, NY, waived indictment and pleaded guilty to aggravated vehicular homicide, a class B non violent felony, on the condition that he be sentenced to an indeterminate term of 5-15 years or 71\/2-15 years in state prison.<\/p>\n
At the time of sentencing, the judge will make a determination whether the Huntress’ prior felony conviction in Pennsylvania will cause him to be sentenced as a second felony offender in the case, which would raise the sentence to 71\/2-15 years.<\/p>\n

Huntress admitted that while engaged in reckless driving and while committing the crime of vehicular manslaughter 2nd, where he admitted he drove his vehicle while ability impaired by combination of drugs, he caused the death of Tomasa Martinez and caused serious physical injury to at least one other person, in this case George McGann, David Stefanski and Minerva Stefanski.<\/p>\n
Huntress also pleaded guilty to three counts of assault 2nd, a class D violent felony, which will run concurrent and on the condition that he is sentenced to a determinate sentence of 5 years plus either 3years or 5 years of Post Release Supervision.<\/p>\n
The charges stem from a July 9, 2017 accident in the Town of Orangeville on Rt. 20A near Boxler’s Farm.<\/p>\n
On July 9, 2017, Huntress ingested various controlled substances and then proceeded to drive from a motel in Warsaw to Chautauqua County.<\/p>\n
While driving westbound on Rt. 20A, Huntress was reportedly driving all over the road according to a concerned citizen who called 9-1-1. During the 9-1-1 call, Huntress struck two motorcycles in the eastbound lane. The first motorcycle was carrying George McGann and Tomasa Marinez. Martinez succumbed to her injuries at WCCH. The second motorcycle was carrying David and Minerva Stefanski who along with McGann continue to struggle with recovery from injuries sustained in the accident.<\/p>\n
