Benito A Gay, aka “Red”, 29, of Vine St., Batavia, was arrested on an active Grand Jury Indictment Warrant for two counts of criminal sale of a controlled substance 3rd and two counts of criminal possession of a controlled substance 3rd, both class B felonies, after he was pulled over in a traffic stop in the Town of Batavia.<\/p>\n
On December 28, 2017, Gay was charged with DUI\/drugs, unlawful possession of marijuana, unlicensed operation and a registration plate display violation after operating a vehicle in the Town of Batavia. Gay was issued tickets during the stop and then released.<\/p>\n
Later, that same evening, it was discovered that there was an active Grand Jury Indictment Warrant for Gay.<\/p>\n
Deputies then went to Gay’s residence on Vine street and arrested him on the warrant.<\/p>\n
Gay allegedly sold crack cocaine to an agent of the Genesee County Drug Task Force on two occasions in the past four months in an around the City of Batavia.<\/p>\n
Gay was held at the Genesee County Jail without bail and will be arraigned at a later date.<\/p>\n
Task Force members were assisted by the Genesee County Sheriff’s Deputies and the District Attorney’s Office.<\/p>\n

Rebecca S. Hensel, 35, of Pratt Rd., Batavia, is charged with felony DWI, felony driving with a BAC of .08% or more and speeding in a zone after a traffic stop on Main street road in Batavia on December 29, 2017.<\/p>\n
Hensel was issued an appearance ticket and will appear in the Town of Batavia Court on February 15, 2018 at 1:00p.m.<\/p>\n
