On May 17th at 5:56PM, Batavia Police responded to Subway, located\u00a0at 412 East Main Street, for a reported robbery. It was reported to responding officers that the suspect had fled in an easterly direction.\u00a0There were no weapons displayed, or threatened, at the time of the incident.<\/p>\n\n\n\n

Batavia Officers were in the area, when an officer located a male matching the description at an apartment complex on East Main Street. The suspect was taken into custody and identified as Benito A. Gay, 34, of Batavia. <\/p>\n\n\n\n

Evidence was recovered subsequent to the arrest. <\/p>\n\n\n\n

Gay is charged with robbery 3rd degree and burglary 3rd degree, both class D felonies.<\/p>\n\n\n\n

Gay was arraigned in Batavia City Court by Judge Burns and held without bail. He is scheduled to appear in Batavia City Court on May 19th at 1:30P.M.<\/p>\n\n\n\n
