Montes, 38, homeless, are each charged with criminal mischief 4th degree after allegedly damaging a vehicle by attempting to unlawfully gain access to the vehicle on Church Street in Elba on February 27, 2023 at 5:00a.m.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both subjects were released with appearance tickets and will appear in Elba Town Court on March 22, 2023 at 5:00p.m.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">__________________________________________________________________________________________________<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Evan F. Maynard, 22, of Batavia, NY, is charged with falsely reporting and incident 3rd degree on February 26, 2023. Maynard reported an alleged crime to a deputy. After an investigation into the complaint, it became apparent that Maynard allegedly reported false information to law enforcement and allegedly pawned several items at a pawn shop on February 25, 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Maynard was issued an appearance ticket and will appear in Batavia Town Court on March 14, 2023 at 3:00p.m.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">_________________________________________________________________________________________________<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gary M. Herrmann Jr., 44, of Caswell Road, Byron, NY, is charged with DWI, and driving with a BAC of .08% or more, following a domestic incident in Byron on February 27, 2023 at 3:30p.m.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Herrmann was issued uniform traffic tickets and released. He is to appear in Byron Town Court on March 20, 2023 at 4:30p.m.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">__________________________________________________________________________________________________<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Brian E. Daggar, 37, of Elba, NY, is charged with petit larceny after allegedly stealing merchandise from a store at 4133 Veteran&#8217;s Memorial Drive on February 26, 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Daggar will appear in Batavia Town Court on March 14, 2023 at 1:00p.m. to answer the charge.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Evan J.
