On Thursday, April 27, 2023, Dominic Mainella, Jr., 57, of Buffalo, NY, was sentenced by the Hon. Michael M. Mohun to 15 years in prison and 5 years of post-release supervision on the charge of burglary second degree, a class \u201cC\u201d violent felony, 1 \u00bd to 3 years in prison on the charge of criminal mischief third degree, a class \u201cE\u201d felony and 364 days in jail on the charge of petit larceny, an A misdemeanor. All of these sentences are concurrent with each other. Mainella still faces a separate charge of burglary in Cattaraugus County where that charge still remains pending without a trial date.<\/p>\n\n\n\n

\u201cHopefully this sentence will forever keep the people of Western New York safe from the career criminal behavior of Mr. Mainella. It is my hope that the Cattaraugus County burglary case will add some additional time to this sentence in order to ensure the safety and security of both of our communities. The sentence he received today is a sufficient and appropriate sentence for the house that he burglarized in Wyoming County. He should not receive a free pass on the Cattaraugus County burglary as those victims were equally harmed by Mr. Mainella\u2019s criminal conduct,\u201d said District Attorney Donald O\u2019Geen<\/p>\n\n\n\n

On Monday, March 2, 2023, Dominic Mainella, Jr.,57, of Buffalo, NY was found guilty by the Hon. Michael M. Mohun. After a 3-day bench trial in Wyoming County Court. Mainella, Jr. was convicted of burglary second degree, a class \u201cC\u201d violent felony, criminal mischief third degree, a class \u201cE\u201d felony and petit larceny, an A misdemeanor.<\/p>\n\n\n\n

This case stems from a home invasion that occurred in the Town of Arcade on November 19, 2021. Mr. Mainella using the cover of his employer\u2019s delivery truck, drove into the victim\u2019s driveway in the mid-morning hours of November 19th. He then damaged garage door and entered the home through the garage where he stole cash from the owner\u2019s wallet. Neither of the homeowners were home at the time.<\/p>\n\n\n\n

Mainella currently has a separate burglary charge pending in Cattaraugus County where it is alleged that on November 29, 2021, using the same employer\u2019s delivery truck as a cover he entered another residence in the Town of Machias stealing jewelry. This alleged crime was committed just 10 days after the burglary in Wyoming County. It is inexplicably still pending in Cattaraugus County Court.<\/p>\n\n\n\n

Dominic Mainella, Jr. was prosecuted for burglary back in 2001 for a home invasion that occurred on French Road in the Town of Bennington. He was sentenced to 15 years in state prison for that offense. Due to that a burglary conviction, he faces a maximum of 15 years in prison.<\/p>\n\n\n\n

This case was prosecuted by Wyoming County District Attorney Donald O\u2019Geen and defended by Joseph Terranova, Esq.<\/p>\n\n\n\n

\u201cI personally prosecuted Mr. Mainella back in 2001 and now 20 years later I prosecuted him again for the same crime. During all but 5 years of the past 35 years of his life Mr. Mainella has either been in prison, on parole, on probation or committing new crimes. It is clear that Mr. Mainella is incapable of living among us without committing crimes. He is a serial burglar who continues to shatter the sanctity of victim\u2019s homes. This prosecution was made possible by the excellent investigative work of Inv. Bradley McGinnis of the Wyoming County Sheriff\u2019s Department, the cooperation of Google, Inc. who provided a witness from out of state and the San Jose County Prosecutor\u2019s Office who also assisted my office in obtaining the witness from Google.
