Knowing that you’ve been involved with the county legislature for the past 14 years, how disappointing was it to you that you didn’t receive the endorsement from either the Genesee County or Le Roy Republicans?

A. So, there is a certain amount of disappointment with that situation, right? But I also recognize that that is a vote of a small minority of the community of Le Roy. So, in putting together petitions for a primary, I believe that the citizens of Le Roy – rather than a small group — have the opportunity to make their feelings be known. Running a primary will certainly do that. Let the citizens vote.

Q. Your opponent, Mr. Vito, has said that you didn’t listen to your constituents and Mr. Lathan (Le Roy Republican Committee chair) has also expressed that same sort of sentiment.

A. I have to start out with the position of the legislature. The legislature is to run the county. It is not to run the town or the village. And certainly, there are connections built back and forth, however, the oath of the office of a legislator is to the county. It is not to the village or town of Le Roy.

The election for a legislator is where people decide and they vote for the person who they think is best going to run and vote at the county level to run the county, right? And I think there’s some misunderstanding there in exactly what the position is.

If the position of, say, the town board or the village board is in conflict with a position that the county takes, that happens quite often. And we can’t always do what is right for one community.

The role here is to run the county.

Q. Have you communicated at all with the people in the county Republican Committee or the Le Roy Republican Committee since their meetings – since the voting? Have you looked into or explored reasons why you didn’t get the endorsement?

A. Absolutely, I have. And the conversations that I’ve had stem around the county sales tax restatement in 2021. And this cannot be taken out of context, which some people like to boil it down to being very simple. It was a difficult time for everyone during COVID. Absolutely difficult.

The county was in a position to have to make a move with our 40-year water agreement with the city (of Batavia). That is tied directly to the sales tax. The county had two options — we either don’t change that agreement or we change the agreement, which enabled us to pursue our Phase 3 water (project) and allowed us to retain four million dollars for the debt service of the (new county) jail. Both of those are county-wide projects. They serve the citizens of the entire county of Genesee.

Q. Talking about water, which is probably the most pressing issue on the table for the county at this point, what is your role in that and where do you see that going?

A. So, my role in the water project is I am the person in the team building the connections with our state and federal representatives. That’s the role that I have taken. And just this past week, we met with our Congresswoman’s new regional representative and we did a sit-down conversation with him, introducing him to what our focus is on water, why it is there, how it is so critically important for our county population, why it’s important to every single resident here and why our singular focus for our large projects is on water.

Phase 3 is big. It’s like fighting for a Super Bowl right now. It’s a $150 million project. We have engaged with a more robust engineering company; we’ve made it change. As the project has grown and as our communities have tapped on for water districts throughout towns, our need has changed and grown. The complexity of this entire project continues to morph and it’s dynamic all the time.

So, in the leadership team of the water itself, I’m the one who interfaces with our representatives in Albany. On Wednesday, I have six meetings set up with different departments and different leaders. And I’m really happy that they’re willing to hear from Le Roy and Genesee County.

Le Roy, right now, is in the middle of a water project to water up the rest of the town’s citizens.

And at this point, I don’t have public water at our place.

Q. That leads me to an accusation or assumption that Mr. Vito made, saying that the water line was moved so that it came toward your farm. He said it was supposed to go one way and then it was rerouted so that your farm would get water. Do you have any response to that?

A. The county doesn’t have a hand in how the town and the town engineers put together a water benefit district. That is all done at the town level. So, there’s no way that I could have any sort of influence over that.

Q. Would you say that the water project overall is starting over again or, if not that, has had to step back a bit because of the changes?

A. We’ve changed from a smaller one (engineering firm) to a more nationwide company that is experienced in working with Great Lakes water and because of the incredible need, we absolutely here at the county have taken a reset on that. There is good work that is being done by our prior engineers on the local level, but this is bigger than all of us because it continues to grow, and the demand continues to grow. And yet we are focused on making sure that our residents have water before we can even look at any further economic development.

Q. Getting to economic development, STAMP (WNY Science & Technology Advanced Manufacturing Park) is a big part of that. What is your role in the Genesee County Economic Development Center and STAMP? Are you on the board? And how much is STAMP contributing to or affecting the need for water?

A. So, that’s interesting, that question in itself. The county water project is supplying just the first water in and it’s around 100,000 gallons a day. That’s all that’s committed from the county water project. Any big water need that is required for any manufacturer, that is completely the responsibility of the GCEDC board.

My involvement with the GCEDC board, I was assigned as a liaison my first two-year term back in 2012-2013. Since that time, I have not been assigned as a liaison to that board at all.

Q. Can you talk about your record as a legislature and your appointment to many committees? Why are you the person that needs to stay in this role to move things forward?

A. When I was first elected in 2011, then legislator chair, Mary Pat Hancock, was the one that assigned the liaison responsibilities, right? So, I was assigned to NYSAC, the New York State Association of Counties. I was put on to the Public Safety Committee for NYSAC. I was placed on the Agricultural Committee. It also afforded me the opportunity to be assigned to Intercounty of Western New York.

Immediately, I was thrust into the advocacy and learning from a peer group. And that really broadened my understanding of what the legislature does. After that time, then legislature chair, Ray Cianfrini, offered and appointed me as Human Service Committee chair. So, now I have the responsibility of being, number one, prepared and ready to move a committee forward in the departments where the county spends the greatest amount of its resources.

After that, Chair Bausch, he then assigned me to Public Service, which really is probably more aligned with the skills that I have from being in a farm family. We worry about roads. We worry about water. We worry about safety. We worry about how we get from one place to another. And that opportunity and that experience also broadened more of my understanding. And being able to work with other legislators who bring so many skills and talents that coalescing a team and building those connections with each other is really critically important.

Which then takes us into the chair, the chairmanship here of the legislature. Understanding all of the pieces that have to come together through Human Service and through Ways & Means to get to the full legislature and the robust discussions that we have, you gotta be ready. You have to be prepared. You cannot just show up and vote. It doesn’t work that way at this at this level.

And I bring the continuity of knowledge as being one of the two legislators that were in public office when the water project started back in the late 1990s. That knowledge allows me to speak with greater awareness, local knowledge, and understanding the benefit that that spine brings to every single community here. We know that our goals are aligned with supporting our new department heads, which are really critical. … So, keeping myself in this position with the knowledge that I have, with the transparency that my votes are always noted, there’s minutes everywhere – it’s important to keep me here.

Q. On the subject of taxes, is it true that counties are subject to the 2 percent tax cap and if they go over that, then they could lose funding from the state for mandated services?

A. That’s correct. It makes it imperative for the county to stay under that.

Q. So, is it fair to say that some of the towns in the county would have had to rethink their finances and efficiencies because they weren’t getting us much from the county as they received before?

A. The county is handcuffed. We are like the filling in between the state trying to stave off mandates that don’t flow down to our towns and villages, right? And there’s no doubt about it. We all at every level of government had a hard time. We recognize that we absolutely have had a hard time … with the sales tax agreement and I know that this is where this is coming back to.

But the county said that when we have extra (money) we will make extra distributions, and the county has done that. So, we’ve made a change. We talked about it for 18 months before we made the change. Those communities who participated and were part of the association meetings, they were fully aware, fully participating in those conversations.

Did the end result end up being what they wanted? Not a hundred percent. But if we’re pleasing everybody a hundred percent of the time, then we’re not taking care of our own house. And the role of the legislator is to take care of the county.

Q. Your stated opponent, Mr. Vito, has made some statements along the lines that you’re on the soil and water conservation group that applies for grants and that your brother-in-law also is on that committee. And he’s insinuating that there’s some personal gain here. Do you have any response to that?

A. This is what I’ll say. Any grant that has been applied for by the farm, by the family business, is competitive at the state level. Any time that there is a topic that would include a perceived conflict, I have always removed myself from the room from the meeting and have never participated in a vote. And I know at the state level that that has happened also. Those competitive grants are statewide.

Q. Have you received a grant?

A. So, our farm – just like many other farms in the county — has been eligible to participate in different grants and these grants are for resource concerns. We farm right along the Oatka Creek.

It’s a blue ribbon trout stream. There is a specific pot of money set aside for the Genesee River. And we have applied for different grants from that for the farm. Absolutely.

But we also turn around and the farm family itself has made themselves available to the Department of Environmental Conservation so that they can train CAFO (Concentrated Animal Feed Operations) inspectors. And farm service agency staff have come out and toured what we have improved upon through grant opportunities.

When we farm locally, the county has an ag and farmland protection plan that says we want land in ag. The town of La Roy has a really robust ag and farmland protection land that says we want farmland. And we are all headed to a net carbon zero. These grants help to address resource concerns whether it’s point source or not point source … opportunities, but it’s competitive and it’s a completely separate panel that does the ranking on those. We have no reach.

So, if this this is kind of the accusations without looking further into the reality, I’m just going to say that’s unfortunate.

Q. Going forward, have you acquired the list of Town of Le Roy Republican Party members to get the required signatures, about 100 or so? Have you assembled a team, or will it be just you going out to fill the petition?

A. You know, I have been receiving a great number of calls and communications asking what they can do to help me right from our community. And so I am taking those people up on their offer of help and some are passing petitions on my behalf. And once I get done with my advocating here in Albany on behalf of our water project and Washington, D.C., I will be out there as well.

(Stein said she will be at the nation’s capital next week, attending the National Association of Counties conference to lobby on behalf of the county’s agriculture industry. A NAC meeting with newly confirmed Secretary of Agriculture Brooke Rollins is on the schedule).

And it’s important for me that people know that I care and that I am transparent and that I will continue to provide the best service that I can be on behalf of the entire community and population of Le Roy and for the county.

Q. Does it hurt you that you’re hearing that people say that you haven’t listened to them or that you bully them or that Mr. Vito has said it’s like the tail wagging the dog.

A. I am disappointed, but I will say this, when you ask for a discussion, it takes two people to have a discussion, right? And when you ask and get no response, it’s pretty hard to have a discussion with yourself about how to move forward. And you know, I’ve never met Mr. Vito.

Q. What would you say to the people of the Town of Le Roy that you represent on the legislature? What would you say to them now that this situation is where it is?

A. Certainly. I would ask them to look at my record, look at the body of my work, look at the public service that I have provided back through to the community. Even from the time I started on the town board as a council member, as supervisor, I know it’s a tough job. I have an opportunity to make sure that the value that I bring to the community continues, and I think that the folks feel that I’m building a connection.

Rochelle (Shelley) Stein is in her sixth year as chair of the Genesee County Legislature, having served as the District 5 (Town of Le Roy) representative since being elected in November 2011.
